BUFFALO, N.Y. \u2013 U.S. Attorney Michael DiGiacomo announced today that Timothy Tundo, 62, of Bethany, NY, pleaded guilty before U.S. District Judge Lawrence J. Vilardo to possession with intent to distribute LSD, possession of firearms in furtherance of drug trafficking, and unlawful possession of machine guns. The charges carry a mandatory minimum penalty of five years in prison and a maximum of life.<\/p>\n\n\n\n

Assistant U.S. Attorneys Joshua A. Violanti and Stacey Jacovetti, who are handling the case, stated that in February 2021, law enforcement executed a search warrant at Tundo\u2019s residence in Bethany, which he maintained to manufacture and distribute controlled substances. During the search they seized quantities of LSD, oxycodone, and marijuana, two machine guns, three assault weapons, 12 long guns, five pistols, a cap gun, ammunition, magazines, $2,500 in cash, and drug paraphernalia.<\/p>\n\n\n\n

The plea is the result of an investigation by the Genesee County Sherriff\u2019s Office, under the direction of Sheriff Joseph Graff, and the Bureau of Alcohol, Tobacco, Firearms, and Explosives, under the direction of Special Agent-in-Charge Bryan Miller, New York Field Division.<\/p>\n\n\n\n

Sentencing is scheduled for November 14, 2025, at 9:30 a.m. before Judge Vilardo.<\/p>\n\n\n\n
