Nelson is charged with driving under the influence of drugs\/driving under the influence of drugs-special category, broken tail lamp and refusing to submit to a urine sample after a Drug Recognition Expert evaluation. <\/p>\n\n\n\n

<\/figure><\/li><\/ul>\n\n\n\nDuring the investigation, 40 grams of marijuana was uncovered along with Xanax pills and a simulated handgun which turned out to be a BB gun that was found under the passenger seat. <\/p>\n\n\n\n

<\/figure>\n\n\n\nJustin Dake, 21, of Brockport, NY, formally of Perry, admitted the drugs were his. Dake is charged with criminal possession of a controlled substance 7th, unlawful possession of marijuana and criminal possession marijuana 4th degree. <\/p>\n\n\n\n
Dake was released on an appearance ticket and Nelson was remanded to the Wyoming County Jail. Both are to appear in Perry Court at a later date. A third person in the vehicle was not charged. Officer Smith was assisted at the scene by the New York State Police.<\/p>\n\n\n\n
