Brian A Simpson II, 38, homeless, was stopped on Ellicott street in the City of Batavia on February 12, 2019 at 11:04a.m. following the observation of a vehicle and traffic violation.<\/p>\n\n\n\n

Simpson was found to have been allegedly operating his motor vehicle while impaired by drugs.<\/p>\n\n\n\n

He is charged with DWAI\/drugs, criminal use of drug paraphernalia 2nd, criminal possession of a controlled substance 7th, unlawful possession of marijuana and promoting prison contraband 1st, a felony, after Simpson was found with drug paraphernalia and a white powdery substance identified as cocaine while being processed at the Genesee County Jail.<\/p>\n\n\n\n

Simpson was arraigned in the Town of Batavia Court and held at the jail on no bail.<\/p>\n\n\n\n

Also charged was Walter H. Bennett, 29, of Rochester. He is charged with unlawful possession of marijuana. Bennett was issued an appearance ticket to appear in City Court.<\/p>\n\n\n\n

The incident is being investigated by members of the Genesee County Sheriff’s Office, including the Genesee County Corrections officers.<\/p>\n\n\n\n

<\/p>\n\n\n\n

Paul G. Avery, 41, of Indian Falls Rd., Pembroke, is charged with DWI, aggravated DWI, driving with a BAC of .18% or more, throwing refuse on the highway, driving to the left of pavement markings and failure to keep right on a highway with four lanes or more.<\/p>\n\n\n\n

Avery will re-appear in Batavia Town Court on March 21, 2019 at 1:00p.m.<\/p>\n\n\n\n

Nathan S. Bowes, 33, of Sokol Dr., Attica, is charged with DWI, driving with a BAC of .08% or more and moving from a lane unsafely after a motor vehicle accident in the Town of Alexander on Buffalo street road in Alexander on February 23, 2019<\/p>\n\n\n\n

Bowes was released on an appearance ticket and will appear in Alexander Town Court on March 19, 2019 at 5:00p.m.<\/p>\n\n\n\n
