Steven D. Smires, 23, no permanent address, was arrested on May 2, 2019 by the Le Roy Police Department and charged with one count of endangering the welfare of a child, a class A misdemeanor and one count of unlawful possession of marijuana, a violation. <\/p>\n\n\n\n

Leah M. Burrus-Stewart, 38, also no permanent address, was arrested as a result of the same incident and charged with one count of endangering the welfare of a child, a class A misdemeanor.<\/p>\n\n\n\n

At approximately 11:30 a.m. on May 2, 2019, the Le Roy Police Department received a complaint of a subject smoking marijuana in a vehicle with two small children inside the vehicle. <\/p>\n\n\n\n

Upon arrival, patrols located a vehicle parked in a municipal parking lot located in the Village and inside the vehicle they located Smires and Burrus-Stewart along with a three-year-old child belonging to Burrus-Stewart and a nine-month-old child that belonged to the couple. <\/p>\n\n\n\n

It is alleged that prior to the patrols arrival, Smires had been smoking marijuana in the vehicle with both children present inside the vehicle. At the time Smires was smoking marijuana, Burrus-Stewart was also inside the vehicle. Patrols also located marijuana and paraphernalia used for smoking marijuana inside the vehicle. <\/p>\n\n\n\n

During the investigation it was also discovered that Smires, Burrus-Stewart, and both the children did not have housing and had been living in the vehicle. Both Smires and Burrus-Steward were arrested without incident and Child Protective Services was contacted to assist with the care of the children. <\/p>\n\n\n\n

Both Smires and Burrus-Stewart were arraigned in the Le Roy Town Court in front of the Honorable Judge Sehm and turned over to the Genesee County Jail in lieu of $750 bail. They are to return to the LeRoy Town Court on June 4, 2019 to answer to the charges. <\/p>\n\n\n\n
