Shane Zimblis, 46, of Buell St., Batavia, is charged with criminal mischief 4th and criminal obstruction of breathing after he fled the incident location on Pearl street Tuesday morning.
Zimblis was located on the CSX railroad right of way and taken into custody after a search of a nearby wooded area.
He was arraigned in the Town of Batavia Court and bail was set at $500.
Deputy Nati, Reeves, Hale, Erion/K-9 Destro, Troopers Daigler, Palizay and Veletta/K-9 Paris all assisted in the search.
Heather E. Gearman, 31, of Park St., Arcade, and Douglas R. Pasinski, 33, of Middle Rd., Springville, are each charged with petit larceny after allegedly stealing merchandise from Dollar General at 9195 Alleghany road in Pembroke on May 15, 2017.
Both were issued appearance tickets and will appear in the Town of Pembroke Court on June 20, 2017 to answer the charge.
Lachian C. Kellogg, 23, of Lancaster Ave., Buffalo, was arrested on an arrest warrant issued out of Batavia City Court on the charge of aggravated unlicensed operation 3rd from March of 2016.
He was arraigned in City Court and jailed in lieu of $1,000 bail.
