Jeffery P. VanNostrand, 52, of Kent was sentenced in Orleans County Court Tuesday morning after pleading guilty to reckless endangerment 1st and DWI, a misdemeanor, in April.
In August of 2016, VanNostrand was driving his vehicle and struck a girl who was riding her bike on Baker road, in Carlton.VanNostrand left the scene. The young girl was transported to the hospital by Mercy Flight.
Today, VanNostrand was sentenced to 2 years in County Jail, 1 year on each charge and each will run consecutive.
Judge Sara Sheldon, of Niagara County, handled the case after Judge James Punch recused himself in December of 2016 when he recalled a similar incident that VanNostrand was involved in almost 20 years ago, Punch was the District Attorney at the time.
Before sentencing, VanNostrand told the Judge he was sorry.
VanNostrand had faced 1-3 years in State Prison, but the Judge gave the option of County Jail time for 2 years. After a brief discussion, both the victim’s family and the defendant chose the County Jail option.
The 8 year old girl is continuing to heal from her injuries, District Attorney Joseph Cardone said, but she is having some problems.
