GENESEE COUNTY/Man indicted after injuring police officer

Joseph B. James has been indicted and accused of assault 2nd, a class D violent felony, after allegedly preventing a police officer from performing a lawful duty and causing physical injury to police officer Sgt. Eric Bolles on May 7, 2017 in the City of Batavia.

James is also accused of criminal mischief 3rd, a class E felony, after he allegedly damaged property in excess of $250.00.  James allegedly damaged a surveillance camera and housing in the holding room at the Batavia Police Department at 10 West Main street on May 7, 2017.

 

Darrell Smith is accused of three counts of coercion 1st, a class D felony, after threatening to kill three different people while allegedly holding a knife in one hand and a glass bottle in the other. Smith threatened physical injury if the victims tried to leave the residence before producing property that Smith demanded on May 6, 2017.

Smith is also accused of criminal obstruction of breathing or blood circulation after applying pressure on the throat or neck of one victim.

In the fifth count of the indictment, Smith is accused of criminal mischief 4th after allegedly intentionally damaging another person’s property/shelving/stereo unit.

In the last count of the indictment, Smith is accused of menacing 2nd after placing another person in fear of physical injury, serious physical injury or death by displaying a deadly weapon, a knife.

 

 

Shawn M. Twardowski, has been indicted on one count of robbery 3rd  after allegedly stealing a person’s cell phone on January 26, 2017.

In count two, Twardowski is accused of cruelty to animals, a class A misdemeanor, contrary to Ag and Markets Law, after he allegedly beat and strangled a dog on January 26, 2017  belonging to a woman in the City of Batavia
