STATE POLICE/Warsaw/Pike man charged after waving and shooting gun

On October 25, 2017 at 11:00 p.m., Troopers arrested Brendan M. Sherman, 28, of Pike, NY, for menacing 2nd, criminal mischief 4th and illegal discharge of a firearm.

Troopers received a report of a male subject waving a gun around outside and having shot the gun multiple times and threatening family members. Troopers responded to the Town of Pike and located Sherman.

Sherman was arguing and threatening family members with the rifle cartridge by shaking it in their faces. He was transported and processed at State Police/Warsaw.

Sherman was arraigned in front of Wyoming County Court Judge Mohun and remanded to the Wyoming County Jail on $5000.00 cash/ $10,000.00 bond. Order of Protections were issued for those involved.

Officer Ward from the DEC was contacted as well for shots fired not within 500ft of a dwelling. 

Sherman re-appeared in the Town of Pike court on October 31, 2017 at 7:30p.m.

On October 21, 2017 at 1:00a.m., Troopers arrested Frank H. Mcewan, 18, of Batavia, NY, for driving while ability impaired by drugs, failure to obey police officer, unsafe turn no signal, unlicensed, drinking alcohol in motor vehicle, deposited refuse on highway, obstructing government administration and criminal nuisance.

A passenger in the vehicle,  Cramer J. D’Andre, 18 of Batavia was arrested for unlawful possession of marijuana and open container.

Mcewan was stopped on Keeney road in the Town of Warsaw for not signaling when turning. Mcewan would not cooperate with Police.

Mcewan did not have a driver’s license and he was violating the conditions of his parole. Troopers contacted Parole out of Rochester, NY and a Parole Violation Warrant was issued.

A Drug Recognition Expert was contacted and an evaluation was conducted on Mcewan for an impairment by drugs. Traffic tickets and appearance tickets were issued returnable to the Town of Warsaw Court on October 30, 2017 at 5:00 p.m.

Mcewan was remanded to Wyoming Co. Jail on the Parole Warrant.

D’Andre was issued appearance tickets returnable in the Town of Warsaw Court on October 30, 2017 at 5:00p.m. D’Andre also had a bench warrant out of Batavia and was remanded to the Genesee County Jail on $1000.00 cash and/or $2000.00 bond.

Troopers responded to a suspicious vehicle on Perry road in the Town of Java, NY on October 23, 2017 about 2:18a.m..

Upon arrival, Troopers observed an individual running from a parked vehicle to a backyard of a residence. Troopers located the vehicle just beyond the residence and a traffic stop was conducted.

The vehicle was located on the westbound shoulder of Perry road. During the traffic stop, Nicholas F. Hutton,21, of Webster, was located in the back seat of the vehicle.

While interviewing Hutton, he admitted to operating the vehicle and stated the vehicle had ran out of gas while driving. During the interview, Troopers detected an odor of an alcoholic beverage emanating from Hutton. He was then placed under arrest after failing standard field sobriety tests and was transported to State Police/Warsaw for processing. Hutton recorded a .10% BAC.

He was issued an appearance ticket returnable to the Town of Java Court on November 1, 2017 at 7:30p.m.

On October 29, 2017 at 8:00p.m., Troopers arrested James L. Gerhardt Sr., 59, of Attica, NY, for aggravated DWI and failure to keep right.

Troopers received a report of a vehicle in the ditch on Plowe road in the  Town of Attica, NY.

Upon arrival, Troopers interviewed Gerhardt, who identified himself as the driver of the vehicle. Gerhardt says he contacted a friend to pull him out.

During the interview, a strong odor of an alcoholic beverage was emanating from Gerhardt who performed field sobriety tests and failed. He was then placed under arrest for DWI and transported to State Police/Warsaw for processing. Gerhardt recorded a .18% BAC.

He was issued traffic tickets and is to appear in the Town of Attica Court on November 13, 2017 at 9:30 a.m.

On October 29, 2017 at 2:38a.m., Troopers arrested Samuel E. Reiner, 21, of Attica, NY, for DWI, unregistered motor vehicle on a highway and muffler exhaust system.

Reiner was observed on Rt. 78 in the Town of Sheldon for an inadequate muffler and a traffic stop was conducted on Dutch Hollow road in the Town of Sheldon.

A registration check came back that the vehicle’s registration was expired. Upon interviewing Reiner, a strong odor of an alcoholic beverage was emanating from the vehicle. Reiner performed field sobriety tests and failed. He was placed under arrest for DWI and transported to State Police Warsaw for processing.

Reiner recorded a .09% BAC.

He was issued traffic tickets and is to appear in the Town of Sheldon Court on November 27, 2017 at 6:30p.m.
