Supporters of Dolores Bustamante showed up in force this morning in front of the Buffalo Federal Detention Center in Batavia.
Bustamante supporters held a rally for the Wayne County apple farm worker before she went inside the facility for her deportation hearing.
Bustamante was stopped by a State Trooper for a minor traffic violation in 2014 and was turned over to immigration authorities. Since then she has worried about being deported and being separated from her daughter who lives in the U.S.
Bustamante says she came to the U.S. with her daughter after fleeing a domestic abuse situation involving her ex-husband.
After a sixty minute hearing Tuesday morning at the Detention Center, the case was continued after the court appointed interpreter called in sick. The Judge decided to adjourn the case until May 8, 2018 at 9:00a.m.
The Judge also made a decision on her attorney’s motion to suppress evidence based on a constitutional violation that she suffered in the hands of State Police when she was transferred to immigration for no other reason than being Latina during the traffic stop in 2014. The motion to suppress was denied by the Judge because the previous attorney in the case already admitted the allegations.
Jose Perez, Bustamante’s current attorney, says he will now file a motion to strike that information from the case and move forward.
