GENESEE COUNTY SHERIFF’S REPORT/Vine street man arrested on Grand Jury Indictment Warrant for possession and sale of cocaine

Benito A Gay, aka “Red”, 29, of Vine St., Batavia, was arrested on an active Grand Jury Indictment Warrant for two counts of criminal sale of a controlled substance 3rd and two counts of criminal possession of a controlled substance 3rd, both class B felonies, after he was pulled over in a traffic stop in the Town of Batavia.

On December 28, 2017, Gay was charged with DUI/drugs, unlawful possession of marijuana, unlicensed operation and a registration plate display violation after operating a vehicle in the Town of Batavia. Gay was issued tickets during the stop and then released.

Later, that same evening, it was discovered that there was an active Grand Jury Indictment Warrant for Gay.

Deputies then went to Gay’s residence on Vine street and arrested him on the warrant.

Gay allegedly sold crack cocaine to an agent of the Genesee County Drug Task Force on two occasions in the past four months in an around the City of Batavia.

Gay was held at the Genesee County Jail without bail and will be arraigned at a later date.

Task Force members were assisted by the Genesee County Sheriff’s Deputies and the District Attorney’s Office.

 

 

Rebecca S. Hensel, 35, of Pratt Rd., Batavia, is charged with felony DWI, felony driving with a BAC of .08% or more and speeding in a zone after a traffic stop on Main street road in Batavia on December 29, 2017.

Hensel was issued an appearance ticket and will appear in the Town of Batavia Court on February 15, 2018 at 1:00p.m.
