GENESEE COUNTY SHERIFF’S REPORT/Business owner charged with forcible touching

Johnny Dinh, 40, of Clinton St. Rd., Batavia, is charged with one count of forcible touching, a class A misdemeanor, after an investigation revealed he allegedly touched another person without their consent or invitation.

The incident occurred at Livia Beauty Spa at 5176 Clinton Street road on February 28, 2018 at 6:00 p.m.

He was issued an appearance ticket and released on his own recognizance.

Dinh will appear in Batavia Town Court on April 9, 2018 at 1:00 p.m.for arraignment.

Under the law, a person is guilty of forcible touching when he or she intentionally, and for no legitimate purpose, forcibly touches the sexual or other intimate parts of another person for the purpose of degrading or abusing such person or for the purpose of gratifying the actor’s sexual desire.

Forcibly touching another includes squeezing, grabbing, pinching, rubbing, or other bodily contact involving the application of some level of pressure to the victim’s sexual or intimate parts.

 

 

Brett N. Magoffin, 42, of Genesee St., Corfu, Is charged with felony DWI, previous conviction within 10 years, felony aggravated DWI, driving with a BAC of.18% or more, prior conviction within 10 years and moving from a lane unsafely after an investigation of a physical altercation in the street at 9590 Simonds road in Darien on March 15, 2018 at 11:16p.m.

Magoffin was issued appearance tickets and will appear in the Town of Darien Court on April 17, 2018 at 4:00p.m.
