PERRY POLICE REPORT/Batavia man charged in traffic stop

On April 21, 2018 in the Village of Perry, Officers performed a routine traffic stop for several equipment violations.

During the traffic stop it was discovered that the vehicle operator, Deric Hewitt, 33, of Batavia, NY , was allegedly operating a motor vehicle under impairment.

Hewitt was arrested in the Village of Perry, for driving while ability impaired by drugs, driving while ability impaired by drugs/special and unlawful possession of marijuana.

Hewitt was arraigned in Perry Village Court in front of Honorable Miller.

Miller committed Hewitt to the Wyoming County Jail in lieu of $500 cash, $2500 bond. He was also ticketed for the equipment violation. Hewitt has a return court date of May 8, 2018 in Perry Village Court at 1:00p.m. to answer the charges.   

 

 

On April 22, 2018 in the Village of Perry,  Officer Spink was on routine patrol in a marked police vehicle.

Officer Spink observed a vehicle that failed to stop at a stop sign. While following the vehicle, Officer Spink observed the vehicle failing to maintain lane. Officer Spink and Smith then performed a routine traffic stop and it was founded that vehicle operator, Ryan Sharpstene, 31, of Churchville, NY, had a suspended driver license.

Sharpstene driver’s license was suspended 29 times on 14 different dates.

It was also found that Sharpstene was allegedly in possession of a controlled substance.

Sharpstene was placed under arrest for aggravated unlicensed operation 1st and criminal possession of a controlled substance in the 7th degree.

Sharpstene was arraigned in Warsaw Town Court in front of Honorable Judge Errington. Judge Errington committed Sharpstene to Wyoming County Jail on no bail. Along with being ticketed for aggravated unlicensed operator in the first degree, Sharpstene was also ticketed for failure to stop at a stop sign, failure to keep right and unlicensed operator.

Sharpstene has a return Court date in the Perry Village Court on May 8, 2018 at 1:00pm to answer the charges.

 

 

On April 20, 2018, at 11:00p.m., Officer Harding was assisting Officer Spink with a traffic stop in the Crosby’s parking lot at 2 South Center Street.

The driver of the vehicle, Travis Tyler, no age or address provided, was driving on a revoked license, and his cousin, Ryan Riley, 18, of Perry, was the passenger.

Officer Harding was speaking to Riley while Officer Spink had Tyler perform field sobriety tests behind the vehicle.

During the search of the vehicle, Officer Harding discovered a marijuana bowl on the floor board on the passenger side of the vehicle, where Riley’s feet would have been.

A small bag of marijuana was also found under the passenger seat that contained 3.7 grams of marihuana buds.

Riley is charged with unlawful possession of marihuana and was issued an appearance ticket to return to the Village of Perry Court on May 8, 2018 at 1:00p.m.

 

 

On April 21, 2018, at 5:16a.m, Officer Harding was patrolling on North Main Street when Lois M. Longdue, 37, of Silver Springs, was observed traveling northbound with several items hanging from the rear view mirror.

Officer Harding performed a traffic stop on Longdue at the intersection of Route 39 and Simmonds Road, in the Village of Perry.

A license check revealed that Longdue was suspended on two separate occasions in March of 2017.

The first suspension was issued on 03/31/2017, in the Town of Chili, for failure to answer a summons and the second suspension on 03/03/2017, in the Village of Warsaw, for failure to answer a summons.

Longdue was issued tickets for driver’s view obstructed and aggravated unlicensed operation in the 3rd degree, an unclassified misdemeanor. She was arrested roadside and released with appearance tickets to return to the Village of Perry Court on May 8, 2018 at 1:00p.m.

 

 

On April 22, 2018, at 9:14a.m, Officer Harding was operating stationary radar on South Main Street in the parking lot of a business, when Norm F. Truax Jr. was observed traveling northbound at a high rate of speed. Truax proceeded to accelerate out of the curve on South Main Street, going from 40 mph to 47 mph in a 30 mph zone.

Officer Harding performed a traffic stop at the intersection of South Main Street and Washington Blvd.

Truax stated that he did not have a license and upon running a license check on Truax, it was discovered that Truax was suspended 7 times on 4 different dates, 6 coming from the City of Rochester in 2009, for failure to answer a summons and failure to pay fines, and 1 from the Town of Nunda on 03/16/2008, for failure to answer a summons.

Truax also had two active warrants in the City of Rochester, one for menacing, on 12/05/2017, and the other for criminal obstruction of breathing, on 03/27/2018.

Truax was transported to the Perry Police Department to process the arrest.

He is charged with speeding in zone for 47mph in a 30mph zone, unlicensed operator, for operating a motor vehicle with an expired license from 01/26/2011, and aggravated unlicensed operation in the 2nd degree, for operating a motor vehicle with more than 3 suspensions on 3 different dates.

Truax was arraigned in the Town of Warsaw Court in front of the Honorable Judge Errington, and was committed to the Wyoming County Jail on $1,500 cash or $3,000 bond bail, and is due to appear in the Village of Perry Court on May 8, 2018, at 1:00p.m.
