A Genesee County Grand jury has indicted a Rochester man, Michael B. Collier, 47, of the crime of attempted assault 2nd , a class E felony, while confined to the Genesee County Jail at 14 West Main street.
On or about March 12, 2018, Collier, while having been charged with or convicted of a crime, was at the Genesee County Jail in Batavia, and intended to cause physical injury to another person, attempting to cause injury to that person or to a third person.
In April, Collier was involved in a police pursuit after allegedly stealing merchandise in Livingston County.

On April 5, around 2:51 a.m., the suspects were observed traveling on Rt. 5 in the Town of Batavia by Deputy Jeremy McClellan of the Genesee County Sheriff’s Department. The suspects continued to refuse to stop for police and fled from Deputy McClellan and other law enforcement agencies who assisted in the pursuit.
The pursuit ended when the suspect vehicle was involved in a one car motor vehicle accident on Rt. 262 near Bank street road in the Town of Byron.
After the crash, both the driver and the passenger fled the scene of the accident on foot.
Deputy Chris Erion and K-9 Destro responded to the scene. Both suspects were eventually located by Erion and K-9 Destro and taken into custody.
The driver of the vehicle, Michael B. Collier, 45, of Gladstone St., Rochester, and his passenger, Gary L. Weese, 44, of West Ave. Medina, were transported to UMMC in Batavia for dog bites.
Collier was then released from UMMC and arraigned in Byron Town Court. He is charged with criminal possession of stolen property 5th, unlawful fleeing a police officer in a motor vehicle 3rd, reckless driving, aggravated unlicensed operation of a motor vehicle 3rd, leaving the scene of a property damage accident, speeding and several other NYS vehicle and traffic law violations.
Collier was jailed in lieu of $50,000 cash bail and is due back in Byron Town Court on April 9, 2018 at 5:00p.m.
Weese is still being treated at UMMC for an unrelated medical condition and will be arraigned at a later date.
Weese is charged with criminal possession of stolen property 5th.
