BATAVIA POLICE REPORT/Ellicott street man jailed after altercation, charged with strangulation

Manuel Mendoza-Stymus, 20, of Ellicott St., Batavia, is charged with strangulation 2nd, criminal mischief 4th, unlawful imprisonment 2nd and endangering the welfare of a child after an altercation at a residence on Ellicott street on December 21, 2018.

Mendoza-Stymus allegedly choked another person and held that person down against their will and took a cell phone from the person who was attempting to call for police assistance.

The incident happened in the immediate proximity of a 6 month old child.

Mendoza-Stymus was arraigned in City Court and jailed without bail.

He re-appeared in court on December 24, 2018.

Emily D. Smith, 33, of Liberty St., Batavia, is charged with assault 3rd and endangering the welfare of a child after an incident at 134 Liberty street on November 22, 2018.

Smith was issued an appearance ticket and will appear in City Court on January 8, 2019 at 1:30p.m.

Patrick M. Viscuso, 54, of Evans St., Batavia, is charged with harassment 2nd and unlawful possession of marijuana following an incident where Viscuso allegedly struck another person on the side of the face during an argument.

Viscuso was also allegdly found with marijuana at the time of his arrest on Evans street on December 18, 2018.

Viscuso was issued an appearance ticket and is due to appear in City Court on January 8, 2019.

Kiha S. McNear, 21, homeless, of Batavia, is was arrested on three separate warrants in three separate cases on December 19, 2018 on Portland avenue in Rochester.

McNear is facing a criminal contempt 2nd and a harassment 2nd charge along with being wanted on a bench warrant. He was issued three appearance tickets and will appear in City Court on January 8, 2019 at 1:00p.m.

McNear was then released.

Triton A. Drock, 24, of East Main St., Batavia, was picked up on an arrest warrant on December 20, 2018 for failure to appear on the charges of aggravated unlicensed operation 3rd and failure to use headlights with windshield wipers on November 18, 2018.

Drock was released on his own recognizance and will appear in City Court on January 17, 2019.

Zackary V. D. Seeley, 22, of Central Ave., Batavia, and Krista Swan, no age or address provided, are each charged with petit larceny after allegedly stealing items from Tops at 390 West Main street on December 18, 2018.

Police responded to a larceny in progress and located the pair who matched the description provided by Tops employees.

Numerous items totaling $306.81 in value were recovered and both Seeley and Swan were released with appearance tickets. They will appear in City Court on January 8, 2019 at 1:00p.m.

Iszon C. Richardson, 18, of Lewis Pl., Batavia, is charge with trespass after allegedly entering and remaining on the property of another person without permission.

Richardson was issued an appearance ticket and will appear in City Court on January 8, 2019.
