WYOMING COUNTY/Man who attacked Sheriff found incompetent to stand trial

Lynn Hall appeared in Wyoming County Court today before the Hon. Michael M. Mohun along with counsel and District Attorney Donald O’Geen .

During the court appearance, the results of two psychiatric exams were formally announced by the court. Both doctors, who had examined the defendant pursuant to the court’s earlier order, concluded that the defendant is incapacitated and is unable to assist in his defense or able to understand the nature of the proceedings.

Based upon those reports, the court entered a ruling declaring the defendant incompetent to stand trial.

Due to the court’s finding all of the criminal proceedings are now stayed until a doctor determines he is competent at some later date.

The Court then ordered the defendant to be held by the Office of Mental Health at a facility of their choosing and the defendant is to be held there until he is determined by the doctor(s) to be fit to stand trial.

Since the defendant is facing a sentence which imposes a life sentence, he will remain in the custody of the Office of Mental Health for the rest of his life unless his mental status changes.

The Court set a return date of July 25, 2019 as a date to check on the defendant’s status. The defendant will remain in jail until a mental health bed is available.

At this time the District Attorney’s Office has no further comment as this case is still pending and the investigation still continues.

On December 11, 2018 at approximately 6:35 A.M., Wyoming County Sheriff Gregory Rudolph was on his way to work in uniform, operating an unmarked Ford Taurus Police Vehicle. While traveling on State Route 238 in the town of Attica, an unknown vehicle began to tailgate Sheriff Rudolph flashing its lights. Sheriff Rudolph pulled over to see if the vehicle needed assistance. The vehicle then pulled in front of the Sheriff’s vehicle blocking him in.

Hall exited his vehicle and met Sheriff Rudolph at the door of his police vehicle and engaged him in a physical altercation. At this point, the Sheriff recognized the man as someone who had applied for a pistol permit and had come to the Sheriff’s Office the day prior to inquire on it. Hall attempted to gain control of the Sheriff’s weapon and a struggle continued to the ground on the side of the roadway. Hall ended up on top of the Sheriff with a knife threatening to take his life. During the ground altercation, two civilian newspaper delivers stopped and assisted the Sheriff along with an off-duty New York State Trooper. Hall was handcuffed and taken into custody.

Sheriff Rudolph was treated for non-life-threatening injuries. The Wyoming County Sheriff’s Office turned the investigation over to the NYSP. Hall was transported and processed at SP Warsaw.

The Bureau of Criminal Investigation (BCI) out of SP Warsaw arrested Lynn M. Hall, 48, of Castile, NY and charged him with attempted murder 1st degree (A-1 Felony), attempted assault 1st degree and criminal possession of a weapon 2nd degree.
