Brian A Simpson II, 38, homeless, was stopped on Ellicott street in the City of Batavia on February 12, 2019 at 11:04a.m. following the observation of a vehicle and traffic violation.
Simpson was found to have been allegedly operating his motor vehicle while impaired by drugs.
He is charged with DWAI/drugs, criminal use of drug paraphernalia 2nd, criminal possession of a controlled substance 7th, unlawful possession of marijuana and promoting prison contraband 1st, a felony, after Simpson was found with drug paraphernalia and a white powdery substance identified as cocaine while being processed at the Genesee County Jail.
Simpson was arraigned in the Town of Batavia Court and held at the jail on no bail.
Also charged was Walter H. Bennett, 29, of Rochester. He is charged with unlawful possession of marijuana. Bennett was issued an appearance ticket to appear in City Court.
The incident is being investigated by members of the Genesee County Sheriff’s Office, including the Genesee County Corrections officers.
Paul G. Avery, 41, of Indian Falls Rd., Pembroke, is charged with DWI, aggravated DWI, driving with a BAC of .18% or more, throwing refuse on the highway, driving to the left of pavement markings and failure to keep right on a highway with four lanes or more.
Avery will re-appear in Batavia Town Court on March 21, 2019 at 1:00p.m.
Nathan S. Bowes, 33, of Sokol Dr., Attica, is charged with DWI, driving with a BAC of .08% or more and moving from a lane unsafely after a motor vehicle accident in the Town of Alexander on Buffalo street road in Alexander on February 23, 2019
Bowes was released on an appearance ticket and will appear in Alexander Town Court on March 19, 2019 at 5:00p.m.
