GENESEE COUNTY/Attorney asks that the case be dismissed against Antwan Odom

On Friday afternoon, Frank Housh, the Attorney representing Antwan Odom in Genesee County Court, requested that the case against his client be dismissed because of an improper Grand Jury decision.

Housh is concerned that the Grand Jury was not able to consider the issue of self defense.

“The fact that Ray (Leach) said he initiated the confrontation at the Preliminary Hearing and Ray said that he won the confrontation, he beat my client up and caused a concussion and put him in the hospital.”

Odom was arraigned on the charges of assault 1st, a class B violent felony, and criminal possession of a weapon 4th, a misdemeanor, on January 8th. He pleaded not guilty.

On August 4, 2018 in the area of 153 Ross street, Odom is accused of causing serious physical injury to another person, Raymond L. Leach III, by means of a dangerous instrument, that being a knife.

Odom is accused of possessing a dagger, dangerous knife, dirk, stiletto, imitation pistol or other dangerous instrument with intent to use unlawfully against another person.

Housh requested a description of the knife, he says the knife was described as 1/2 the length of a pen which is not a standard length of measurement.

“They have no other witnesses in the case and they don’t have the knife, they only have Ray Leach’s testimony.”

District Attorney Larry Friedman told the court this is the only description we have of the knife.

“We don’t know what he did with it, we are ready for trial.”

Judge Charles Zambito reserved his decision and will have a decision on whether the Grand Jury proceeding will be dismissed on April 11 at 10:30a.m.
