Guillermo Torres- Acevedo, 23, of Batavia, was arraigned in Genesee County Court on Monday morning after allegedly taking a 14-year-old Byron girl to Pennsylvania on November 29, 2018, causing an Amber Alert and manhunt.
Police say Torres-Acevedo allegedly abducted the teen that morning near Byron-Bergen high school. Torres-Acevedo and the 14 year old girl were found later that afternoon by police in a Mansfield, Pennsylvania Walmart parking lot.
He is charged with custodial interference 1st, criminal contempt 2nd and endangering the welfare of a child.
In April, The US Attorney’s Office charged Torres-Acevedo with transporting a minor across state lines for sexual activity. That charge carries a mandatory minimum penalty of 10 years in prison, a maximum of life, and $250,000 fine.
Since November 29, 2018 he has been held without bail.
Tom Burns, Torres-Acevedo’s attorney, says his client is an American Citizen who has no prior criminal history who would be living locally. He requested that bail be set at $5,000 cash or $10,000 bond.
Judge Charles Zambito agreed to that bail amount due to a bail evaluation which shows Torres-Acevedo with 20 points. The evaluation was knocked down to 9 points due to the federal charge of transporting a minor across state lines for sexual activity.
An order of protection was issued on behalf of the victim and is in effect for one year.
Oral arguments are scheduled for August 15, 1:30p.m.
