Richard D. Hanes, 36, of Batavia, appeared in Genesee County Court on Friday afternoon with his attorney Fred Rarick to reject the plea offer of murder 2nd with a sentencing cap of 20 years to life.
“Based on the brutality of the crime, I will be looking for the strongest sentence,” says District Attorney Larry Friedman.
Hanes will face a minimum of 15-life and a maximum of 25 to life sentence if found guilty.
Hanes is charged with murder 2nd in connection with the murder of Raymond Morgan, which occurred on July 24, 2018 at 111 Liberty street.
Hanes quickly became a person of interest in the homicide through a tip, and has been in custody on Parole violations since July 26, 2018, two days after the homicide.
Ray Morgan, 47, left behind seven grandkids and two daughters.
Today, Morgan’s family had some choice words after Hanes appeared in court.
They shouted, “I hope you die!” “I hope you get 25 to life.” as they exited the court room.
After court, Morgan’s family expressed that they were not happy that Hanes did not take the plea deal. They will have to re-live the brutal murder of their loved one all over again through the trial.
According to a former friend who has served time with Hanes in the past, he can be very arrogant and likes to be in jail. He spends his time drawing.
The trial will begin on July 22, 2019 with Jury selection.
