WYOMING COUNTY SHERIFF’S REPORT/Two charged in simultaneous traffic stops

Two individuals were arrested following simultaneous traffic stops on State Route 20A in the Town of Sheldon on July 4, 2019. Austin T. Horn, 20, was driving a 2004 Pontiac Grand AM while following a vehicle in front of him too closely.

Jessica L. Marini, 20, who was driving behind Horn, was pulled over for driving a vehicle with an expired certificate of inspection. It was later found that Horn and Marini were traveling together. Both are from West Seneca

Both Horn and Marini were each found to be in possession of marijuana in their separate vehicles. Horn failed roadside field sobriety testing and was taken into custody for DWAI/Drugs. Horn was taken to the Wyoming County Sheriff’s Office where he tested positive for alcohol on a breath test. Horn was then evaluated by a Wyoming County Sheriff’s Office Drug Recognition Expert and determined to be impaired by the combined influence of alcohol and cannabis. Horn is charged with DWAI/Drugs, DWAI Combination of Drugs and Alcohol, following too closely, and unlawful possession of marijuana.

Marini was also charged at the Wyoming County Sheriff’s Office with unlawful possession of marijuana and uninspected motor vehicle.

Both were released and are scheduled to appear in the Town of Sheldon Court on July 29, 2019 to answer the charges.

Parker E. Payton, 20, of Pavilion, was arrested following a traffic stop on York Road in the Town of Pavilion on July 5, 2019. Payton was observed driving on Route 63 in the Town of Covington several feet into the oncoming lane while traffic was flowing in the opposite direction past his vehicle.

Payton drove his vehicle onto Perry Road then turned on to York Road where deputies were able to conduct a traffic stop. Payton was found to be in underage possession of alcohol in plain view within his vehicle. A subsequent vehicle search found Payton to be in possession of marijuana inside a grinder, concentrated cannabis, and a forged NYS driver’s license.

Payton also failed field sobriety testing and was taken into custody for DWAI Drugs. Payton was taken to the Wyoming County Sheriff’s Office where a Drug Recognition Expert performed a drug influence evaluation with Payton. Payton was found to be impaired by cannabis and unable to operate a vehicle safely.

Payton is charged with DWAI/Drugs, reckless driving, criminal possession of a controlled substance 7th, unlawful possession of marijuana, unlawful possession of alcohol by a person under 21, possession of a fictitious driver’s license, and multiple other traffic infractions.

Payton was released to a sober third party and is scheduled to answer the charges in the Town of Covington Court on July 29, 2019.

Following a domestic incident that occurred in the Town of Middlebury, Philip D. Burrs, 37, of Middlebury was arrested for criminal mischief 4th and endangering the welfare of a child on July 4, 2019.

Burrs was arraigned in the Town of Middlebury Court and released on his own recognizance with a refrain from order of protection put into place. Burrs is to re-appear in Middlebury Town Court on July 8, 2019.

Brian Lanpher, 43, of Gainesville, NY, was arrested following an investigation into damaged property at a local business on July 2, 2019.

Following an investigation, it was determined that Lanpher allegedly damaged property belonging to a local construction company in an attempt to cause an inconvenience to the operation of the company.

As a result, he is charged with criminal tampering 3rd.

Lanpher was arraigned in the Town of Warsaw Court.

Following the arraignment, he was released to the pre-trial release program and an order of protection was issued for the victim.

Lanpher is to re-appear in the Town of Warsaw court on July 15, 2019 for further proceedings.

The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty
