WYOMING COUNTY SHERIFF’S REPORT/Convicted felon charged in traffic stop, Warsaw man charged after leaving his dog in hot car

Two individuals were arrested following a traffic stop on Wing Street in the Town of Eagle on July 14, 2019.

Donald J. Brown, 58, was operating his 2017 Ford F150 on Wing Street when he was pulled over for traffic infractions. Brown and his wife, Stacey M. Brown, 53, both of Niagara Falls, were found inside the vehicle, and a strong odor of marijuana was detected emanating from within the vehicle.

A vehicle search led to the discovery of marijuana, paraphernalia, and an illegal “billy” club. Donald Brown, a convicted felon, was determined to be the owner of the club. Donald Brown also performed poorly on roadside field sobriety testing and was taken to the Arcade Police Department where he was evaluated by a Drug Recognition Expert. Donald Brown was found to be impaired by multiple categories of drugs and unable to operate a vehicle safely.

Stacey Brown was issued an appearance ticket for unlawful possession of marijuana and released. She is scheduled to answer the charge on July 29, 2019 in the Town of Eagle Court.

Donald J. Brown is charged with criminal possession of a weapon 3rd, a class D felony, unlawful possession of marijuana, DWAI/drugs, Driving While Ability Impaired by the Combined Influence of Multiple Drugs, unauthorized stickers on windshield and driver’s view obstructed.

Donald J. Brown was arraigned in the Town of Eagle Court where he was released on his own recognizance. The Wyoming County District Attorney’s Office had recommended $5,000.00 cash bail or $10,000.00 bond.

Brown was processed at the Wyoming County Jail and then released. Brown is scheduled to return to the Town of Eagle Court on July 29, 2019 for further proceedings.

On July 13, 2019, the Wyoming County Sheriff’s Office responded to the Wal-Mart parking lot in Warsaw, for a report of a dog left in a vehicle.

Upon arrival, the Deputy located the dog and observed that the dog was sweating profusely, breathing heavily, and having a hard time keeping its head up. The Deputy unlocked the vehicle and supplied the dog with water.

The owner, Jeremy Harris, 38, of Warsaw, exited the store and approached the vehicle. Harris advised that he did not intend on being in the store for so long. Due to the extreme temperature and condition of the dog, Harris is charged with confinement of a companion animal in a vehicle during extreme temperatures. Harris is to answer the charges on a later date.

On July 12, 2019, Nicholas A. Perry, 20 of Strykersville, was charged with unlawful possession of marijuana following a traffic stop on Manley Road in the Town of Sheldon.

Perry was issued an appearance ticket returnable to the Town of Sheldon Court on August 5th, 2019.

“The fact that a defendant has been charged with a crime is merely an accusation, and the defendant is presumed innocent until and unless proven guilty.”
