Benjamin Santiago Jr., 30, of Batavia was arraigned in Genesee County Court on Wednesday morning in a burglary/robbery/assault/larceny incident that occurred on June 2, 2019 at 216 Ellicott street.
Santiago is facing an eight count indictment where he is accused of felony robbery, assault, and grand larceny.
When the victim refused to give Santiago money at 216 Ellicott street, he allegedly hit him with a blunt object several times. Santiago then stole items in the residence.
Santiago left the scene, allegedly stealing a bicycle, and then a vehicle from a residence in the Town of Batavia.
Rochester Police located Santiago and recovered the stolen vehicle. He has been jailed without bail since June.
Today, Judge Zambito discussed bail during arraignment. Attorney Robert King requested $10,000 cash and $20,000 bond.
District Attorney Larry Friedman told the Judge that Santiago Jr. has two prior felony convictions, one was for bail jumping. Friedman requested no bail.
“He is somebody we were concerned about having released for good reason based on his history and previous conviction for bail jumping,” says Friedman.
King told the court that Santiago Jr. has a serious drug problem and was a lifelong Batavia resident.
Judge Zambito then set bail at $100,000 cash and $200,000 bond after requesting a suggested amount from Friedman.
Orders of protection were issued for several people, Santiago Jr. is not to possess any guns and oral arguments are scheduled for October 30, 2019 at 1:30p.m.
