GENESEE COUNTY/Batavia man sentenced in murder of Ray Morgan last summer

Richard D. Hanes, 36, of Batavia appeared for sentencing on Wednesday morning in Genesee County Court.

Hanes was found guilty of murder 2nd in July after a weeklong trial in the beating death of Ray Morgan at 111 Liberty street last summer.

Several family members of Ray Morgan spoke at sentencing.

Before sentencing, Judge Charles Zambito told Hanes he has averaged one arrest a year since 1998 with a total of 20 arrests since then. The murder 2nd conviction is the 4th felony conviction for Hanes. According to the Judge, Hanes parole was revoked six times and his probation was revoked twice.

“The probation Department has done an evaluation and they consider you the greatest risk to society, you clearly have a substance abuse problem, but that does not excuse your criminal history,” said Judge Zambito.

“Based on your record alone, its a clear indication you cannot function in society.”

Police Officers involved in the case, who were in court, told the Judge this was the most brutal and gruesome crime scene they have ever experienced.

“I’ve seen the evidence and the pictures, at least 25 blows with a hammer, its not considered a weapon, but you made it into a deadly weapon. That takes clear intent and that is a personality that does not belong in society.”

“To beat him to death and not know why is unsettling, you will never be safe for society.”

Judge Zambito then sentenced Hanes to the maximum of 25- life and told Hanes he will not recommend any early release or parole.

“Murder is murder, everyone life is precious. Ray Morgan has family and friends left behind that will now have to live with this and suffer at your expense. The nature of this crime and your actions after it are very disturbing.”
