GENESEE COUNTY SHERIFF’S REPORT/Man charged with DWI after falling off his motorcycle

Jesse James Smoody, 43, of 8th Ct., Westfield, WI, is charged with DWI and aggravated DWI, driving with a .18% BAC or more, following a welfare check at 6890 Byron Holley Road in Byron, The Crosby’s store, on September 15, 2019 at 12:53a.m.

Smoody had allegedly fallen off his motorcycle in the parking lot of the convenience store.

After further investigation, it was determined that Smoody allegedly operated the motorcycle on a public highway in an intoxicated condition.

He was released on appearance tickets and is scheduled to appear in Byron Town Court on October 21, 2019 at 5:00p.m.

Schnell A. Ogletree, 30, of Eagle Ln., Camillus, NY, is charged with aggravated unlicensed operation 1st, driving while ability impaired by drugs, criminal possession of a controlled substance 7th, aggravated unlicensed operation 2nd and unlawful possession of marijuana 2nd after a traffic stop on Rt. 33 in Stafford on September 14, 2019 at 9:14a.m.

After observing vehicle and traffic violations, Ogletree was pulled over by deputies. It was determined that she was allegedly operating her vehicle while her ability to do so was suspended due to a previous DWAI/alcohol conviction.

While speaking with Ogletree,, the odor of burnt marijuana was allegedly detected emanating from the vehicle. A search of the vehicle found that she was in possession of controlled substance.

Field sobriety tests were administered, and it was determined that Ogletree was allegedly operating her motor vehicle while her ability to do so was impaired by drugs.

She was transported to the Genesee County Jail where Deputy Richard Schildwaster, a certified Drug Recognition Expert, conducted a drug influence evaluation.

Following the evaluation, Deputy Schildwaster also came to the determination that Ogletree was under the influence of drugs and unable to operate her vehicle safely.

She was issued appearance tickets returnable to the Town of Stafford Court along with the charges of speed in a zone and unlicensed operator.
