BATAVIA POLICE REPORT/Oakfield man charged after refusing to leave establishment

Joseph C. Barone, 39, of N. Pearl St., Oakfield, is charged with obstruction of governmental administration, harassment 2nd, unlawful possession of marijuana and trespass after he refused to leave a business/establishment at 214 East Main street on September 21, 2019 at 2:04a.m.

Barone allegedly attempted to strike an employee and physically resisted with Batavia Police.

He was issued an appearance ticket and is scheduled to appear in City Court on October 1, 2019 at 1:30p.m.

Zachary J. Gillard, 24, of West Ave., Elba, is charged with DWI and aggravated DWI, driving with a BAC of .18% or more, after a disturbance at local business at 214 East Main street on September 22, 2019 at 2:44a.m.

Gillard was released to a third party with appearance tickets and will appear in City Court on October 2, 2019 at 9:00a.m.

Grace C. Murray, 20, of Pratt Rd., Pavilion, is charged with petit larceny and conspiracy following a shoplifting incident at Dollar General at 412 East Main street on September 18, 2019 at 11:06a.m.

Murray was released on an appearance ticket and is scheduled to appear in City Court on October 1, 2019 at 1:00p.m.

Andrew J. Rock, 33, of N. Spruce St., Batavia, is charged with criminal contempt after he allegedly had contact with a protected party of a stay away order while he was at the Genesee County Jail on September 6, 2019.

Rock was issued an appearance ticket and released into the custody of the Jail.

He is scheduled to appear in City Court on October 1, 2019.

Jacob L. Hernandez, 25, of Holland Ave., Batavia, is charged with criminal trespass 2nd after allegedly entering a residence on Prune street without permission and then refusing to leave on September 22, 2019 at 5:54a.m.

Hernandez was processed and will appear in City Court on October 1, 2019 at 1:00p.m.
