GENESEE COUNTY/Indictments

A Genesee County Grand Jury has indicted Kevin J. Weber, 48, of Batavia. Weber is accused of assault 2nd, a class D violent felony, after allegedly causing serious physical injury to a person on Judge road in Alabama on September 19, 2019.

In count 2, Weber is accused of menacing 3rd, a class B misdemeanor, after allegedly placing or attempting to place another person in fear of death, imminent serious physical injury or physical injury during the same incident on September 19, 2019.

Dalton C. Kelly, 21, of Batavia, has been indicted and is accused of assault 2nd, a class D violent felony, after assaulting a person on Chase Park in Batavia on September 18, 2019.

In count 2, Kelly is accused of menacing 2nd, a class A misdemeanor. Kelly allegedly intentionally placed or attempted to place another person in rear of physical injury, serious physical injury, or death by displaying a dangerous instrument in the same incident on September 18, 2019.

Louis C. Restivo, 25, of Bergen, has been indicted by a Genesee County Grand Jury. He is accused of assault 2nd, a class D violent felony, after allegedly intentionally causing physical injury to a person by means of a dangerous instrument.

Ernest D. Lane, 61, of Batavia, has been indicted and accused of aggravated family offense, a class E felony, after allegedly disobeying a mandate of the court, a valid stay away family offense order of protection that was issued on March 28, 2019 in Batavia City Court.

In count 2, Lane is accused of criminal contempt 2nd, a class A misdemeanor, after intentionally disobeying a lawful mandate, violating an order of protection on April 8, 2019, which required him to stay away from the home of the protected person.

Lane was previously convicted of menacing 3rd on January 18, 2018 in Batavia City Court, the previous conviction was within a 5 year time frame of the current indictment.

Katrina L. Gerace, 36, of East Aurora, was indicted and is accused of DWI as a class E felony, after she allegedly did operate a vehicle on Rt. 262 in Elba on June 3, 2019 while she was allegedly intoxicated.

In count 2, Gerace is accused of aggravated DWI per se, as a class E felony, in the same incident on Rt. 262 in Elba. Gerace was allegedly driving with a BAC of .18% or more as shown by a chemical analysis of her breath.

Gerace was previously convicted of DUI/alcohol or controlled substance as a misdemeanor with a BAC of .16% or more on December 8, 2014 in Erie County, PA.

Steven M. Lindner, 46, of West Main St., Batavia, has been indicted and is accused of criminal possession of a controlled substance 3rd, a class B felony, after allegedly knowingly and unlawfully possessing a narcotic drug, cocaine, with intent to sell it on June 18, 2019 in the City of Batavia.

In count 2, Lindner is accused of criminal possession of a controlled substance 3rd, a class B felony, after allegedly knowingly and unlawfully possessing a narcotic drug, Fentanyl, with intent to sell it on June 18, 2019 in the City of Batavia.

In count 3, the indictment further accuses Lindner of criminal possession of a controlled substance 5th, a class D felony, after allegedly knowingly and unlawfully possessing a controlled substance, cocaine, that weighed 500 milligrams or more on June 18, 2019 in the City of Batavia.

In count 4, Lindner is accused of criminal possession of a controlled substance 7th, a class A misdemeanor, after allegedly knowingly and unlawfully possessing a controlled substance, Fentanyl, on June 18, 2019 in the City of Batavia.

In count 5, Lindner is accused of criminal possession of a controlled substance 7th, a class A misdemeanor, after allegedly knowingly and unlawfully possessing a controlled substance, Alprazolam, on June 18, 2019 in the City of Batavia.

In count 6, Lindner, is accused of unlawful possession of marijuana 2nd, a violation, on June 18, 2019 in the City of Batavia.

Adam M. Kreutz, 30, of Batavia, has been indicted and is accused of the crime of offering a false instrument for filing 1st, a class E felony, after a supporting deposition dated June 22, 2019 contained a false statement or false information about a car crash and theft of a car that was found submerged in a pond two weeks after the crash. The car was found in the Town of Byron on July 3, 2019.

In count 2, Kreutz is accused of falsifying business records 1st, a class E felony, after he allegedly made a false entry in a supporting deposition dated June 22, 2019, to conceal the commission of reckless driving.

Shonje K. Jefferson, 20, of Rochester was indicted and is accused of the crime of criminal possession of a controlled substance 3rd, a class B felony, after a traffic stop in the City of Batavia on June 27, 2019.

Jefferson allegedly knowingly and unlawfully possessed a narcotic drug, cocaine, with intent to sell it.

In count 2, Jefferson is accused of unlawful possession of marijuana 2nd during the same traffic stop in the City of Batavia.

Jay W. Schafer, 26, of Batavia, was indicted and is accused of the crime of criminal possession of a firearm, a class E felony.

Schafer allegedly possessed a Smith and Wesson, model 10, .38 Special Revolver on June 19, 2019 in the City of Batavia.
