PERRY POLICE REPORT/Rochester pair charged with DWI in traffic stop

On December 7, 2019, at about 8:10p.m., Officers from the Village of Perry were notified of a possible driver operating a vehicle under the influence leaving a business.  

Officers conducted a routine traffic stop on South Main Street on the vehicle. It was discovered that the vehicle’s operator, 32-year-old Brian Planert, of Rochester, NY, was operating the motor vehicle with a revoked license after a driving while intoxicated conviction dating back to 2014.

A license check on Planert revealed he had three previous driving while intoxicated convictions, with two being within the past 10 years. Planert was to believe to be operating a motor vehicle under the influence and asked to perform field sobriety testing, Planert refused.

Officer Spink placed Planert under arrest for DWI.

Further investigation revealed that the passenger, 29-year-old Lindsey Loomis-Obrien, of Rochester, NY operated the motor vehicle shortly before the traffic stop and appeared to be under the influence and was asked to perform field sobriety testing. After performing poorly on field sobriety tests, Officer Croll placed Loomis- Obrien under arrest for DWI. A license check on Loomis-Obrien revealed she had one prior driving while intoxicated conviction within 10 years.

While in police custody, Planert broke out of his restraints, breaking a set of handcuffs. Planert and Loomis-Obrien both refused a breath test to determine their BAC.

Planert is charged with DWI- 2 previous convictions within 10 years (felony) , aggravated unlicensed operator in the 1st degree and 2nd degree, criminal mischief in the 4th degree, unlawful possession of marijuana in the second degree, and ticketed for no seat belt, open container, and unlicensed  operator.

Loomis-Obrien is charged with DWI- 1 previous conviction with 10 years (felony)

Loomis-Obrien and Planert were arraigned in Perry Village Court in front of Honorable Judge Miller. Judge Miller committed Loomis-Obrien to the Wyoming County Jail in Lieu of $500.00 cash, $2500.00 bond.

Planert was jailed in lieu of $2000.00 cash $5000.00 bond.

Loomis-Obrien and Planert both will return to court on January 14, 2020 at 1:00pm in Perry Village Court to answer the charges.
