WYOMING COUNTY SHERIFF’S REPORT/Driver charged under Leandra’s Law in Castile

On January 17, 2020, a Deputy from the Wyoming County Sheriff’s Office conducted a traffic stop on North Main Street in the Village of Castile after observing vehicle and traffic violations.

Further investigation revealed that the operator, Kelly McMurtry, 43, of Portageville, NY, was possibly impaired by drugs. A roadside DWI investigation was then conducted which included the performance of Field Sobriety testing.

After performing poorly on the testing, McMurtry was then asked to submit to a Drug Influence Evaluation, conducted by a certified Drug Recognition Expert.

Following the evaluation, McMurtry was found to be impaired by drugs and unable to operate a vehicle safely. McMurtry is charged with aggravated DWI – child in vehicle, DWAI/Drugs, endangering the welfare of a child, and failure to keep right.

McMurtry was issued an appearance ticket and is scheduled to return to the Village of Castile Court on January 27, 2020.

A traffic stop led to the arrest of a Batavia man on Silver Lake Road in the Town of Perry on January 21, 2020.

Christopher M. Sims, 31, was found to be in operation of his vehicle while the registration was suspended for an insurance lapse.

Sims was arrested and charged with operating with a suspended registration. Sims was issued an appearance ticket and released.

Joseph A. Milano III, 33, of Warsaw, was arrested following a traffic stop on Route 20A in the Town of Sheldon on January 21, 2020.

Milano is charged with operation with a suspended registration after a registration check of his vehicle showed a suspension for insurance lapse.

Milano was issued an appearance ticket returnable to the Town of Sheldon Court on February 10, 2020.
