WYOMING COUNTY SHERIFF’S REPORT/Two from Arcade facing drug charges after being found in a vacant apartment in Eagle

Two subjects face felony charges following a complaint in the Town of Eagle on January 22, 2020.

Wyoming County Sheriff’s Deputies responded to Route 39 in the Town of Eagle to assist a landlord with a suspicious condition following an eviction. When assisting the landlord with checking the property, two subjects were found unlawfully inside the vacated apartment.

Jennifer L. Barber, 35, and Louis S. Szabo, 19, both of Arcade, were located inside a bedroom of the apartment, and a chemical odor was detected within the bedroom.

Barber and Szabo were then found in possession of 9.23 grams of Methamphetamine, a pill containing Codeine, two cartridges of concentrated cannabis, a scale with multiple glassine baggies, an imitation handgun, other drug paraphernalia, and a counterfeit United States of America one hundred dollar bill. Barber and Szabo were taken into custody and each charged with the following:

Criminal Possession of a Controlled Substance in the Third Degree (Class B Felony)

Possession of a Forged Instrument in the First Degree (Class C Felony)

Criminal Possession of a Controlled Substance in the Seventh Degree (Class A Misdemeanor – 2 Counts)

Criminally Using Drug Paraphernalia in the Second Degree (Class A Misdemeanor)

Barber and Szabo were both arraigned in Wyoming County Court and released on their own recognizance. Both are scheduled to re-appear in Eagle Town Court on January 27, 2020.

Dustin M. Thomas, 29, of Leicester, NY, was arrested following a traffic stop on Hathaway Road in the Town of Castile on January 24, 2020. Thomas was stopped for a traffic infraction, and he was found to be operating with a revoked driver’s license from a previous DWI conviction. Thomas was also found to have an ignition interlock restriction which he was operating in violation of, and was found in possession of an amount of marijuana.

Thomas is charged with:

Aggravated Unlicensed Operation in the Second Degree

Operating in Violation of Ignition Interlock Restriction

Unlicensed Operator

Driver’s View Obstructed

Unlawful Possession of Marihuana

Thomas was issued an appearance ticket roadside and released from custody. He was turned over to a valid driver, and is scheduled to answer the charges in Castile Town Court on February 3, 2020.

On January 25, 2020, deputies were patrolling southbound on Route 39 in the Town of Castile, when the passenger of the vehicle in front of the deputy’s patrol vehicle threw an item out of the moving vehicle and onto the highway.

Deputies initiated a vehicle and traffic enforcement stop on Route 39 near Swyers Road. Upon further investigation, the driver of the vehicle was identified as Aaron W. Smith, 32, of Oakfield, who had two active suspensions on his license out of the Town of Alabama.

Smith was arrested and issued an appearance ticket for aggravated unlicensed operation in the 3rd degree and is scheduled to appear in the Town of Castile Court at a later date.

The passenger of the vehicle was also issued a citation for littering on a highway.
