GENESEE COUNTY/Indictments/Man accused of having bags of cocaine in his underwear while being processed at the jail

Edwin Peart Jr. has been indicted by a Genesee County Grand Jury and is accused off the crime of criminal possession of a controlled substance in the third degree, a class B felony. On Aug. 29, 2019, in the City of Batavia, Peart Jr. knowingly and unlawfully possessed a narcotic drug, cocaine, with the intent to sell it.

In count two, he is accused of promoting prison contraband in the first degree, a class D felony. Peart allegedly introduced dangerous contraband, cocaine, into the Genesee County Jail.

In count three, Peart Jr. is accused of the crime of tampering with physical evidence, a class E felony. On Aug. 29, 2019, believing certain evidence was about to be produced or used in an official proceeding, Peart Jr. allegedly tried to suppress it, by an act of concealment, alteration, destruction, by using force, intimidation or deception against any person. Peart, while being processed at the Genesee County Jail, allegedly retrieved objects, later determined to be bags of cocaine, from his underwear and placed them in his mouth and began chewing them refusing all commands to open his mouth and spit the substance out.

Chance J. Barnwell-McClary and Marvelous C. Williams have been indicted and accused of the crime of criminal possession of a controlled substance in the third degree, a class B felony.

On Oct. 10, 2019, in the Town of Byron, both Barnwell-McClary and Williams knowingly and unlawfully possessed a narcotic drug, Fentanyl, with the intent to sell it.

In count two, both Barnwell-McClary and Williams are accused of the crime of criminally using drug paraphernalia in the second degree, a class A misdemeanor.

In count two, both subjects knowingly possessed or sold gelatin capsules, glassine envelopes, vials, capsules or any other material suitable for packaging of individual quantities of narcotic drugs or stimulants under circumstances evincing an intent to use or under circumstances evincing knowledge that some person intended to use and unlawfully manufacture, package or dispense a narcotic drug or stimulant.

A Genesee County Grand Jury has indicted Schnell A. Ogletree. She is accused of the crime of driving while ability impaired by drugs, as a misdemeanor.

On Sept. 14, 2019, in the Town of Stafford, Ogletree allegedly was driving a 2012 GMC Terrain on Route 33 in Stafford while her ability was impaired by the use of drugs.

In count two, she is accused of aggravated unlicensed operation of a motor vehicle in the first degree, a class E felony. It is alleged that when Ogletree was operating her vehicle, she knew or had reason to know that her license or privilege to operate was suspended or revoked.

In count three, Ogletree is accused of criminal possession of a controlled substance in the seventh degree, a class A misdemeanor. She allegedly knowingly and unlawfully possessed a controlled substance, cocaine. Ogletree was previously convicted of driving while ability impaired by the consumption of alcohol on June 12, 2019, in the Town of Onondaga. This conviction forms the basis of count two in the current indictment.

James R. Blakeslee has been indicted and is accused of the crime of driving while intoxicated, as a class E felony. On Dec. 28, 2019 in the Town of Le Roy on Route 19, Blakeslee was allegedly driving a 2003 Dodge while intoxicated.

In count two, Blakeslee is accused of DWI, a class E felony. It is alleged that the Blakesee had a BAC of .08 percent or more at the time, according to an chemical analysis of his breath.

Blakeslee was previously convicted of DWI as a misdemeanor on Sept. 16, 2014 in Wyoming County Court, and that conviction was within 10 years previous of the crimes alleged in the current indictment.

Walter H. Bennett has been indicted and accused of the crime of criminal possession of a controlled substance in the third degree, a class B felony. On Oct. 24, 2019 in the City of Batavia, Bennett knowingly and unlawfully possessed a narcotic drug, cocaine, with the intent to sell it.

In count two, he is accused of criminal possession of a controlled substance in the seventh degree, a class A misdemeanor. On Oct. 24, 2019, in the City of Batavia, he knowingly and unlawfully possessed a controlled substance, cocaine.

Shamya Brown has been indicted and is accused of the crime of grand larceny in the fourth degree, a class E felony. On March 18, 2019, in the Town of Batavia, Brown allegedly stole cosmetics and or skin care items having a value exceeding $1,000.

Darel D. Tingue has been indicted and is accused of the crime of criminal possession of a controlled substance third degree, a class B felony.

On September 9th and or 10th, 2019, in the City of Batavia, Tingue knowingly and unlawfully possessed a stimulant, amphetamine/dextroamphetamine, with intent to sell it.

In count two, Tingue is accused of the crime of criminal possession of a controlled substance in the seventh degree, a class A misdemeanor. On September 9th or 10th, 2019, in the City of Batavia, he knowingly and unlawfully possessed a controlled substance, cocaine.

In count three, the indictment further accuses Tingue of the crime of criminally using drug paraphernalia in the second degree, a class A misdemeanor. On September 9th or 10th, 2019, Tingue did knowingly possess or sell scales or balances used or designed for the purpose of weighing or measuring controlled substances under circumstances evincing an intent to use, or under circumstances evincing knowledge that some person intended to use the same for the purpose of unlawfully manufacturing, packaging or dispensing of any narcotic drug or stimulant.

In count four, Tingue is accused of the crime of trespass, a violation.

On or about September 9th or 10th, 2019, in the City of Batavia, Tingue knowingly entered or remained unlawfully in or upon a premise, UMMC at 127 North street.
