Batavia Police were called to Maple street for an unknown problem at 4:31p.m. on May 1, 2020.
After an investigation, Nelson E. Figueroa Jr.,31, of Maple street, Batavia, was arrested and charged with criminal sex act 1st, actor 18 yrs or more/victim under 13, a class B felony, sexual abuse 1st, victim less than 13/defendant 21 or older, a class D felony, and predatory sexual assault against a child/under 13, a class A-II felony.
A person is guilty of predatory sexual assault against a child when, being eighteen years old or more, he or she commits the crime of rape in the first degree, criminal sexual act in the first degree, aggravated sexual abuse in the first degree, or course of sexual conduct against a child in the first degree, and the victim is less than thirteen years old.
Figueroa was arraigned in City Court and remanded to the Genesee County Jail without bail.
He is scheduled to re-appear in City Court on June 4, 2020 at 11:00a.m.
