BATAVIA POLICE REPORT/Ellicott avenue man arrested on a warrant for attempted burglary

Luis A. Ramos-Mercado, 35, of Ellicott Ave., Batavia, was arrested on a City Court arrest warrant on May 26, 2020.

Mercado is charged with attempted burglary 1st, use or threaten the use of a dangerous instrument, criminal possession of a weapon 3rd, previous conviction and menacing 2nd/weapon, after an incident at 432 East Main street on January 30, 2019 at 2:30a.m.

Mercado was released under supervision and will appear in City Court on July 9, 2020 at 9:00a.m.

Trevawn O. Wright, 19, of Highland Park, Batavia, is charged with two counts of harassment 2nd, after a physical disturbance on Highland Park on May 25, 2020.

After an investigation, it was found that Wright allegedly punched a male in the head and attempted to strike another male with a jug of water.

Wright was later arrested and issued an appearance ticket and is to appear in City Court on July 21, 2020 at 1:30p.m.

Dalton J. Rarick, 30, of Whitefield Ave., Buffalo, is charged with DWI, aggravated DWI, driving with a BAC of .18% or more, and refusing a preliminary breath test, after an investigation into Rarick allegedly operating his vehicle while allegedly intoxicated on May 29, 2020.

Rarick was released on appearance tickets and will appear in City Court on July 15, 2020 at 9:00a.m.

Alan R. Murray, 74, of Spencer Court, Batavia, is charged with felony DWI, previous conviction within 10 years, and driving with a BAC of .08% or more, after an incident on Roosevelt avenue on March 12, 2020 at 8:28a.m.

Murray was released on two uniform traffic tickets and is scheduled to appear in City Court on June 3, 2020 at 9:00a.m.

Brian K. Dyer, 53, of North St., Batavia, is charged with harassment 2nd, following an investigation into a fight/disturbance on Ross street on May 23, 2020.

Dyer will appear in City Court on July 21, 2020 at 1:30p.m.

Thomas J. Leonard, 36, homeless, of Batavia, is charged with petit larceny, after allegedly stealing items from a store at 412 East Main street on May 26, 2020.

Leonard fled the scene, but was apprehended by police after a store employee pointed him out according to police.

Leonard was released on an appearance ticket and will appear in City Court on July 21, 2020 at 1:30p.m.

Rae C. Cook, 31, of Liberty St., Batavia, is charged with criminal contempt 2nd, following an incident where she was allegedly found in the presence of a protected party who had an order of protection on May 30, 2020 at 5:43a.m.

Cook was issued an appearance ticket and will appear in City Court on July 21, 2020 at 1:00p.m.

Carrie L. Vargo, 35, of Tonawanda Creek Rd., Clarence, is charged with criminal contempt 2nd, after allegedly violating an order of protection by having contact with a protected party through email.

The incident occurred on May 14, 2020.

Vargo was issued an appearance ticket and will appear in City Court on July 14, 2020 at 1:00p.m..

A 17 year old female was arrested and charged with unlawful possession of marijuana, after a domestic incident in Batavia on May 24, 2020.

The teen was allegedly in possession of a quantity of marijuana and was issued an appearance ticket.

They will appear in City Court on July 21, 2020 at 1:00p.m.

Nikkia M. Farias, 22, of Thorpe St., Batavia, is charged with unnecessary noise, following an investigation into several noise complaints on Thorpe street on May 26, 2020 at 3:17a.m.

Farias was issued an appearance ticket and will appear in City Court on July 14, 2020 at 1:00p.m.
