BATAVIA POLICE REPORT/Rochester man facing charges after incident on Willow street

Andre L. Roberts, 27, of Burrows St., Rochester, is charged with burglary 2nd, harassment 2nd, criminal mischief 4th, preventing emergency assistance, and obstructing governmental administration 2nd after allegedly entering a dwelling and attempting to prevent a resident in the household from calling 9-1-1 on June 24, 2020 at 10:11p.m.

Roberts also allegedly resisted being detained by police.

He was arraigned in City Court and released under the supervision of Genesee Justice.

Roberts will re-appear in court on August 13, 2020 at 11:00a.m.

Kevin M. Waleski Jr.,32, of State St., Batavia, is charged with burglary 2nd, criminal mischief 4th, attempted criminal mischief, resisting arrest and obstruction of governmental administration following an incident on Ellicott avenue on June 26, 2020 at 2:25a.m.

Waleski was allegedly found inside the enclosed patio of a third party residence without permission.

He was arraigned in City Court by Judge Rogers via Skype and held without bail.

Waleski is due back in court on August 13, 2020 at 11:00a.m.

The case is being handled by Officers Borchert, Roberts. Perkins and Girvin.

Desmond R. Miller, 25, of E. Bayard St., Seneca Falls, NY, is charged with grand larceny 4th, a class E felony, following an investigation into a stolen motorcycle on Oak street on May 24, 2020.

Miller was arraigned in City Court and released on his own recognizance.

He is scheduled to re-appear in City Court on August 20, 2020 at 9:00a.m.

Darius L. Jones, 28, of N. Spruce St., Batavia, is charged with harassment 2nd, criminal mischief 3rd and criminal obstruction if breathing or blood circulation, after a domestic incident at a City residence.

Jones was arraigned in City Court and jailed without bail.

He is due back in court on July 23, 2020.

Booker T. Ricks, 48, of N. Lyon St., Batavia, is charged with endangering the welfare of a child after an investigation into an incident on June 25, 2020 on North Lyon street, where two small children were observed climbing out of a second story window onto the roof of the residence.

Ricks was issued an appearance ticket and will appear in City Court on July 28, 2020 at 1:00p.m.

Jose A. Rivera, 33, of Swan St., Batavia, is charged with criminal mischief 3rd after he allegedly slashed the tires on a vehicle on Swan street on June 25, 2020 at 3:43 p.m.

Rivera was processed at the Batavia Police Department and then arraigned in City Court and released.

He is to return to court on August 13, 2020 at 9:00a.m.

A 17 year old female is charged with unlawful possession of fireworks, after police responded the the area of 129 State street for multiple fireworks complaints on June 28, 2020 at 10:26p.m.

Police found the teen to allegedly be in possession of, and using a Roman candle.

The teen was issued and appearance ticket and will appear in City Court on July 29, 2020 at 1:00p.m.
