WYOMING COUNTY/East Aurora woman charged under Leandra’s Law after allegedly forcing vehicles off the road and fighting with deputies in Wethersfield

On August 7, 2020, at around 7:23p.m., Deputies received a report of an erratic driver traveling eastbound on Wethersfield Road, in the Town of Wethersfield.

The complainant advised the vehicle was straddling the center line and forcing other vehicles off of the roadway.

At around 7:32pm, while responding to the area, Deputies located the vehicle still traveling eastbound on Wethersfield Road, in the Town of Gainesville, which was still straddling the center line as the Deputy had to move onto the north shoulder of the roadway to avoid colliding with the suspect vehicle.

A vehicle and traffic enforcement stop was conducted and the driver was identified as Rachael L. Liptak , 38, of East Aurora. After initially interviewing Liptak, deputies asked Liptak to perform standardized field sobriety testing, which she performed poorly. While Deputies were attempting to place Liptak under arrest, she resisted arrest by fighting with two deputies. A 9 year old female passenger was also in the vehicle at the time of the incident.

Liptak was transported to the Wyoming County Sheriff’s Office where she submitted to a drug influence evaluation conducted by a NYS Certified Drug Recognition Expert.

Following the evaluation, it was determined that Liptak was impaired by several different drugs and unable to operate a motor vehicle safely. Liptak is charged with Aggravated DWI – w/child passenger less than 16 (Leandra’s Law DWI), DWAI Drugs, DWAI Drugs Combo, Fail to Keep Right, Operate Motor Vehicle w/ Suspended Registration, Reckless Driving, Resisting Arrest and Endangering the Welfare of a Child.

Liptak was arraigned via Skype by Judge Errington, of the Warsaw Town Court, for the purposes of a DWI refusal. Liptak was released on her own recognizance and is scheduled to appear in the Wyoming County Court at a later date.
