WYOMING COUNTY SHERIFF’S REPORT/East Bethany man arrested after assaulting deputy

An East Bethany man has been arrested following the assault of a Wyoming County Sheriff’s Deputy in the Village of Gainesville on September 23, 2020.

David M. Schmieder, 26, of Silver Road, East Bethany, was arrested on October 1, 2020 at Erie County Medical Center upon his release from the facility.

On September 23, 2020 at 1:04p.m., the Wyoming County Sheriff’s Office was contacted regarding Schmieder, who was walking down the middle of Route 19 obstructing traffic and acting irrationally.

Upon arrival of deputies, Schmieder refused to follow orders and ignored deputies. One deputy was allegedly forcefully punched in the head by Schmieder. A short struggle then ensued, and both deputies were able to get Schmieder into custody.

Schmieder was found to have an amount of suspected drugs in his mouth which he refused to spit out. The injured deputy was transported to the Wyoming County Community Health System for treatment of non-life threatening injuries. Schmieder was transported to Wyoming County Community Health System for treatment of a medical condition.

Upon Schmieder’s release from the hospital at Erie County Medical Center, Schmieder was transported to the Wyoming County Jail for virtual arraignment in front of Wyoming County Judge Mohun.

Schmieder is charged with assault 2nd, tampering with physical evidence, obstructing governmental administration 2nd, resisting arrest, and disorderly conduct and obstructing traffic.

He was also arraigned on a violation of probation.

Schmieder was held without bail on the violation of probation, and was held on bail for the criminal charges in the amounts of $100,000.00 cash, $200,000.00 bond, or $200,000.00 partially secured bond.

Andrew T. Pape, 31, of Churchville, faces felony charges after he attempted to flee from Wyoming County Sheriff’s deputies in his vehicle on October 2, 2020.

Pape drove by a stationary Wyoming County Sheriff’s Office patrol vehicle with multiple equipment infractions on his vehicle, and when the patrol vehicle pulled out, Pape fled in his vehicle at a high rate of speed.

When the patrol vehicle caught up to Pape’s vehicle and attempted to conduct a traffic stop, Pape drove his vehicle off the roadway, through a residential yard, and behind a residence. Pape exited his vehicle throwing keys and alcoholic containers, but was taken into custody immediately without incident.

Following an investigation at the scene, Pape was arrested for DWI. Pape was found to have a previous conviction for DWI in 2011 in the Town of Ogden, Monroe County, and Pape’s vehicle was also found to have a suspended registration. Pape was transported to the Wyoming County Sheriff’s Office for a breath test, after which he was charged as follows:

Felony DWI, driving with .08% BAC or higher, a felony, operating a suspended registration, reckless driving, failed to stop entering roadway, illegal window tint, unauthorized stickers on rear windshield, visibility distorted by broken glass, failure to comply with lawful order, failure to yield the right of way to an emergency vehicle, driver’s view obstructed, and consumption of alcohol in motor vehicle.

Pape was issued an appearance ticket and released to a sober family member. He is scheduled to answer the charges in the Town of Covington Court on October 12, 2020.

On September 21, 2020, at around 5:36p.m., the Wyoming County Sheriff’s Office Dispatch Center received several 911 calls about an erratic driver who was traveling southbound on Route 19, in the Town of Warsaw, in a tan Ford Ranger. A deputy responded to the area and located the suspect vehicle in the village of Silver Springs.

While operating stationary patrol on East Perry Avenue, the suspect vehicle was observed traveling eastbound through the intersection with Main Street at an extremely slow speed. The deputy followed the vehicle eastbound and observed the suspect cross both the yellow center line and the white hazard line several times. After the suspect vehicle almost left the roadway into a line of trees, a vehicle and traffic enforcement stop was conducted on East Lake Road.

The driver of the vehicle was identified as David L. Eaton, 54, of Castile. While conducting a roadside investigation, the deputy believed Eaton may have been under the influence and asked him to perform standardized field sobriety testing, which he performed poorly.

Eaton was placed under arrest for DWAI/ drugs and transported to the Wyoming County Sheriff’s Office where he submitted to a drug influence evaluation conducted by a NYS Certified Drug Recognition Expert. Following the evaluation, it was the DRE’s expert opinion that Eaton was under the influence of several different drugs and could not operate a motor vehicle safely.

Eaton was ultimately charged with DWAI/drugs, DWAI/ drugs combo, failure to keep right and driving across hazard markings.

Eaton was released with appearance tickets and is scheduled to appear in the Village of Silver Springs Court at a later date.

On September 30, 2020, Christina Hagen, 27, of Wyoming, was arrested by the Wyoming County Sheriff’s Office for aggravated DWI. Hagen was observed driving on North Main Street in the Village of Warsaw after dark with no headlights or taillights on.

A traffic stop was conducted on the vehicle.

The investigating deputy observed signs of impairment by Hagen and requested that Hagen submit to field tests. Hagen failed the field tests and was placed under arrest for DWI. HAGEN was then transported to the Wyoming County Sheriff’s Office where she submitted to a breath test which resulted in a positive reading above .18% BAC level.

HAGEN is charged with DWI, driving with a BAC level over .08%, aggravated DWI over .18% BAC, and other vehicle and traffic law violations.

Hagen was issued an appearance ticket and released to a sober third party. Hagen is to answer the above charges in Warsaw Town Court on a later date.

Dennis J. Mills, 58, of Varysburg, was arrested following a traffic stop on Route 20A at Route 77 in the Town of Sheldon on October 1, 2020. Mills, who is known to police to have a revoked driver’s license, was observed by police driving his 2000 Dodge Ram, color blue and silver, westbound on Route 20A.

Mills was pulled over and taken into custody without incident.

Mills is charged with driving with a revoked identification card only, with a total of 11 suspensions/revocations including multiple DWI revocations. He is also charged with aggravated unlicensed operation 2nd, aggravated unlicensed operation 3rd, and unlicensed operation.

Mills’ vehicle was towed from the scene, and he was issued an appearance ticket to answer the charges in the Town of Sheldon Court on October 12, 2020.

Jason L. Darby, 48, of Warsaw, was arrested following a traffic stop on North Main Street in the Village of Warsaw on October 2, 2020. Darby, who is on NYS Parole for robbery, is known to police to have a suspended and expired driver’s license.

Darby drove past a Wyoming County Sheriff’s Deputy on North Main Street, at which time Darby was pulled over for driving with a suspended driver’s license.

Darby was found to allegedly have two bags of marijuana in the vehicle as well.

Darby is charged with aggravated unlicensed operation 3rd, unlicensed operation, driver’s view obstructed, and unlawful possession of marijuana 2nd. Darby was issued an appearance ticket and released from the scene.

Kari J. Irvine, 33, of Warsaw, was arrested on a Wyoming County Superior Court Warrant for violation of drug treatment court on October 3, 2020.

The warrant was issued pursuant to Irvine’s arrest on August 25, 2020 for criminal possession of a controlled substance 7th. Irvine was held in the Wyoming County Jail awaiting an available session of Wyoming County Court.
