Juan M. Mendez, 20, of Holley, was arrested and charged with rape 1st, a class B felony/sexual intercourse with another person who is incapable of consent by reason of being physically helpless, on December 28, 2020 in the Town of Batavia.
Mendez allegedly had sexual intercourse with a female victim who was incapable of consent due to her level of intoxication, rendering her helpless.
Mendez is being held at the Genesee County Jail on $2,500 bail , $10,000 bond.
He is due back in Batavia Town Court on January 28, 2021.
