GENESEE COUNTY SHERIFF’S REPORT/Batavia man charged after domestic incident

William R. Kapelke, 38, of W. Main St. Rd., Batavia, is charged with criminal obstruction of breathing and endangering the welfare of a child after an investigation into a domestic incident in the Town of Batavia on December 31, 2020.

Kapelke allegedly choked his wife during a verbal and physical argument. The incident allegedly occurred in the presence of the victim’s child who is under the age of 17 years old.

Kapelke was arraigned at the Genesee County Jail and released on his own recognizance.

He will appear in Genesee County Court on March 3, 2021.

Tammy R. Daigler, 44, of Chapman Pl. Tonawanda, NY, is charged with DWI, driving with a BAC of .08% or more, aggravated unlicensed operation 3rd and failure to keep right on a two lane road, after a traffic stop for vehicle and traffic violations on Wiard street in Batavia on January 1, 2021 at 2:37a.m.

Daigler was issued appearance tickets and will appear in City Court on January 13, 2021 at 9:00a.m.

Deputy Quackenbush was assisted by the City of Batavia Police during the traffic stop.
