BATAVIA POLICE REPORT/Batavia man charged after domestic incident

Mark L. Farley, 52, of Harvester Ave., Batavia, is charged with unlawful imprisonment, criminal obstruction of breathing and criminal contempt 1st, following a domestic incident investigation on December 31, 2020.

Farley was arraigned in City Court and held on $1,000 A, $2,500 B and $5,000 E. He was transported to the jail where he was held.

Farley will return to court on January 28, 2021 at 2:30pm.

David N. Hanna, 44, homeless, of Batavia, is charged with obstructing a governmental official and failure to obey a police officer after a suspicious behavior incident at 20 Center street on January 6, 2021 at 2:13am.

While out on patrol, Officer McGinnis noticed a vehicle operating in the area of Jackson street and Center street exhibiting suspicious behavior.

After watching the vehicle for some time, Officer McGinnis approached the driver, later identified as Hanna, to investigate the possibility of intoxication.

Hanna then immediately attempted to flee from Officer McGinnis in his vehicle, but was stopped a short time later when other officers arrived on scene.

Hanna was highly uncooperative with officers and refused to get out of his vehicle. He was then placed under arrest.

Hanna was released on an appearance ticket and is due in City Court on February 16, 2021 at 1:00p.m.

Kyle A. Scheuerlein, 28, of Overlook Dr., Batavia, is charged with harassment 2nd after allegedly spitting on another person during an argument on December 18, 2020 at 412 East Main street.

He was arraigned in City Court and released on recognizance, but held on charges in a separate incident. Scheuerlein will appear in City Court on February 2, 2021 at 3:30pm on the above charge.

Scheuerlein was also charged with criminal contempt 2nd and burglary 2nd, after he was observed by a City of Batavia Police Officer at the residence of a person who he was to stay away from in a stay away order of protection.

Scheuerlein was arraigned in City Court and held on $7,500 A, $15,000 B and $25,000 E. He is due back in court on February 4, 2021 at 3:30pm.

John A. Cabrera, 53, of Mill street, Batavia, is charged with criminal trespass and harassment, after pushing a person during an argument at a rooming house on Mill street on January 6, 2021 at 4:21p.m.

Cabrera was arraigned in City Court and released on his own recognizance. He will re-appear in court on February 25, 2021 at 1:30pm.

Linda A. Styer, 34, of Clay Street, LeRoy, is charged with harassment 2nd following an investigation at 587 East Main street, a local business, where Styer allegedly pushed a shopping cart into another person during an argument.

Styer was released on an appearance ticket and will appear in City Court on February 23, 2021 at 1:00pm.

David P. Haka, 57, of Bowerman Ave., Scottsville, NY, was arrested on a an arrest warrant for a petit larceny that occurred on September 28, 2020 at 601 East Main street.

Haka was arraigned in City Court and released on his own recognizance and will re-appear in court on February 24, 2021 at 2:00pm.

Frank J. Morrocco, 64, of Grant St., Depew, was arrested on an arrest warrant out of Batavia City Court for a petit larceny at 419 West Main street, a local business, on March 14, 2020.

Morrocco was arraigned and released under the supervision of Genesee Justice. He is due back in court on February 25, 2021.

Jason W. Whitehead, 23, of Shady Lane, Batavia, is charged with criminal mischief 4th, following an incident at 505 East Main street, a local business, where Whitehead allegedly damaged the vehicle of another person during an argument on December 30, 2020 at 2:42pm.

Whitehead was issued an appearance ticket and will appear in City Court on February 16, 2021 at 1:00pm.

Casandra M. D’arconte, 22, of Bank St., Batavia, is charged with criminal contempt 2nd, after allegedly violating and order of protection on December 31, 2020.

D’arconte was released on an appearance ticket and will appear in City Court on February 23, 2021 at 1:00pm.

Randy K. Wilmet, 44, of Bank St., Batavia, failed to appear in City Court on a previous arrest and a bench warrant was issued for Wilmet. He was arrested on January 1, 2021 and jailed in lieu of $5,000 A, $10,000 B or $20,000 C. Wilmet re-appeared in court on January 5, 2021.
