BATAVIA/West Main street man facing a felony arson charge after allegedly throwing a bottle with flammable liquid at the front window of a residence

Charles J. Rodriguez Sr., 44, of W. Main St., Batavia, is charged with arson 1st degree, a class A-1 felony, after an incident on Osterhout avenue on November 26, 2020 at 6:25p.m.

Rodriguez Sr. allegedly lit and threw a bottle filled with a flammable liquid at the front window of a residence, which caused the window to break. The bottle did not go into the residence, but did cause a fire.

There was an uninvolved person inside the residence at the time and Rodriguez Sr. knew that person was inside at the time. There was minor damage to the residence, no one was injured.

Rodriguez Sr. was virtually arraigned on February 2, 2021 in Batavia City Court before Judge Rogers, and remanded to the Genesee County Jail without bail. He will re-appear in court on February 25, 2021 at 2:30p.m.
