GENESEE COUNTY/Rochester man facing charges after a struggle with police over a firearm, leading to a brief pursuit in Batavia

The Genesee County Sheriff’s Office is investigating an incident that occurred at the Speedway gas station at 204 West Main street in the City of Batavia at 2:28a.m. March 21, 2021.

The City of Batavia Police responded to the business to check the welfare of individuals who did not appear to acting normal.

Upon arrival, Batavia Police officers located three subjects inside a vehicle in the parking lot.

While investigating the situation, officers observed a handgun inside the vehicle. A struggle then occurred involving the firearm and the driver of the vehicle, Charles L. Jackson, 26, of Rochester. Jackson was able to free himself from officers, he then fled the scene in his vehicle. During the incident, a City of Batavia Police officer discharged his duty weapon.

A pursuit then ensued with the suspects, which ended in the area of Woodland drive in the Town of Batavia when Jackson crashed the vehicle. Jackson and two other occupants of the vehicle were taken into custody without further incident.

Jackson and his two occupants sustained minor injuries as a result of the crash.

He is charged with criminal possession of a weapon 2nd for possessing a loaded firearm, and two counts of criminal possession of a weapon 3rd for possessing two large capacity magazines.

He was arraigned in Batavia City court by Judge Rogers and remanded to the Genesee County Jail in lieu of $25,000 cash bail or $50,000 bond. The other two occupants of the vehicle have not been charged.

Jackson is also charged with outstanding warrants from the Town of Bergen and Stafford pertaining to a traffic stop on Rt. 33 in the Town of Stafford on September 8, 2020. Jackson was the operator of the motor vehicle in the traffic stop and fled from the scene, leading patrols on a pursuit into Monroe county which was terminated without Jackson being taken into custody.

In the September 8, 2020 incident, Jackson is charged with two counts of reckless endangerment 1st, unlawful fleeing an officer, obstructing governmental administration and criminal possession of controlled substance 7th. He was arraigned in Stafford Town Court by Judge Penepent and released on his own recognizance in this incident.

The Speedway gas station incident remains under investigation and no further information will be released at this time.
