A Genesee County Grand Jury has indicted Qumane J. Santiago and accused him of the crime of assault second degree , a class D violent felony. On Oct. 23, 2020, in the City of Batavia, Santiago allegedly intentionally tried to prevent a police officer from performing his lawful duty and caused physical injury to that police officer.
In count two, Santiago is accused of assault second degree during the same incident as mentioned in count one. He is accused of causing serious physical injury to another person or to a third person during the above mentioned incident.
In count three, Santiago is accused of resisting arrest, a class A misdemeanor, after allegedly intentionally attempting to prevent a police officer from making an arrest during the above mentioned incident.
In count four, Santiago is accused of obstructing governmental administration in the second degree, a class A misdemeanor, after allegedly intentionally obstructing a public servant from performing an official function by means of intimidation, physical force, interference or any independently unlawful act during the above mentioned incident.
In count five, Santiago is accused of criminal mischief fourth degree, a class A misdemeanor, after allegedly intentionally damaging another person’s property, a flat screen television, lights, lamps and picture frames during the above mentioned incident.
Greg R. Solomonidis has been indicted for the crime of assault second degree, a class D violent felony. On July 22, 2020, in the Town of Alexander, Solomonidis is accused of causing serious physical injury to another person, he caused such injury to such person or to a third person.
James D. Weathers and Ayeola N. Williams have been indicted for the crime of criminal possession of a weapon second degree, a class C violent felony. On Oct. 31, 2020 in the Town of Stafford, Weathers and Williams knowingly possessed a loaded firearm, a loaded Glock 19 handgun.
In count two, Williams is accused of driving while ability impaired by alcohol, in a 2019 Volkswagen Jetta on Clinton Street Road in Stafford, while her ability was allegedly impaired by the consumption of alcohol on the same above date as mentioned in count one.
Jose A. Rivera has been indicted and is accused of the crime of burglary second degree, a class C violent felony. On Jan.10, 2021, in the City of Batavia, Rivera allegedly knowingly entered and remained unlawfully in a building on Swan Street intending to commit a crime therein.
In count two, Rivera is accused of criminal contempt second degree, after allegedly intentionally disobeying a court order of protection on the same date mentioned in count one.
Mark D. Tooley has been indicted for the crime of driving while intoxicated, as a class E felony, after allegedly operating a 2007 Honda on Nov. 19, 2020 on West Main Street Road in the Town of Batavia, while he was in an intoxicated condition.
In count two, Tooley is accused of driving while intoxicated, per se, as a class E felony, for having allegedly having a BAC of .08 percent or more as shown by a chemical analysis of his breath during the same incident mentioned in count one above..
In count three, he is accused of the crime of aggravated unlicensed operation of a motor vehicle in the first degree, a class E felony, after allegedly driving while knowing that his license or privilege to operate was suspended or revoked. Tooley was allegedly operating his motor vehicle while under the influence of alcohol or a drug.
In count four, Tooley is further accused of false personation, a class B misdemeanor, for allegedly knowingly misrepresenting his name, date of birth or address to a police officer with intent to prevent the officer from ascertaining such information during the same incident mentioned in count one.
In count five, he is accused of unlawfully fleeing a police officer in a motor vehicle third degree, a class A misdemeanor. It is alleged that on the above mentioned date, when Tooley was directed to stop his vehicle by a uniformed police officer or a marked police vehicle by the activation of either lights or lights and sirens, Tooley allegedly attempted to flee, driving at speeds of 25 mph or more above the speed limit.
In count six, Tooley is accused of speeding, a violation, for allegedly driving at speeds in excess of 55 mph/100 mph.
Tooley is accused of having been convicted of driving while ability impaired by drugs, as a class D felony on Nov. 29, 2011 in Genesee County Court, and that conviction forms the basis for the suspension or revocation, and is referred to in count three of the current indictment.
Derek Melendez has been indicted for the crime of grand larceny fourth degree, a class E felony. On Oct. 29, 2020 in the Town of Bergen, Melendez is accused of stealing a credit card belonging to another person.
In count two, Melendez is accused of burglary second degree, a class C violent felony. Melendez allegedly entered a dwelling on West Bergen Road with the intent to commit a crime on the above mentioned date in count one.
In count three, he is accused of criminal possession of stolen property in the third degree, a class D felony, after allegedly knowingly possessing stolen property exceeding $3,000 on the same date mentioned in count one.
In count four, Melendez is accused of driving while ability impaired by drugs after allegedly driving a 2020 Nissan Altima with Maryland license plates on West Bergen road, while his ability was impaired by the use of drugs
Madalyn R. Muntz has been indicted and is accused of criminal possession of a controlled substance in the third degree, a class B felony. On Aug. 12, 2020, in the City of Batavia, Muntz knowingly and unlawfully possessed a narcotic drug, cocaine, with intent to sell it.
In count two, Muntz is accused of criminal possession of a controlled substance in the fourth degree, a class C felony. Muntz allegedly knowingly and intentionally possessed one or more preparations, compounds, mixtures or substances containing a narcotic drug, cocaine, with an aggregate weight of one-eighth ounce or more on the same above date and location.
In count three, she is accused of criminal possession of a controlled substance in the seventh degree. Muntz allegedly knowingly and unlawfully possessed a controlled substance, buprenorphine and Naloxone(Suboxone) on the above date and location in count one.
Jeremiah N. Walker and Samid P. Graves have each been indicted and are accused of the crime of grand larceny fourth degree, a class E felony. On Oct. 28, 2020 at Tops Supermarket at 128 West Main Street in LeRoy, both are accused of stealing property with a value in excess of $1,000, $1,058.35 worth of property.
Sharada M. Crumpler has been indicted and is accused of the crime of driving while intoxicated as a class E felony. On Oct. 21, 2020, Crumpler is accused of driving a 2020 Nissan with Tennessee license plates on the NYS Thruway/ I-90 in the Town of LeRoy while in an intoxicated condition.
In count two, Crumpler is accused of DWI, per se, as a class E felony, after allegedly having a BAC of .08 percent or more at the time on the above mentioned date and location.
In count three, she is accused of speeding, a violation, after driving at a speed greater than was reasonable and prudent under the conditions/potential hazards on the same above date and location.
In count four, she is accused of speeding, a violation-in excess of the maximum established speed limit-118/65mph zone, for driving in excess of the maximum established speed limit for that public highway on the same above date and location.
Crumpler is accused of having been previously convicted of DWI as a misdemeanor, on Sept. 30, 2015 in the City of Rochester and that conviction was within 10 years of the crimes alleged in the current indictment.
