The assault against an officer was dismissed. I am the defendant. I was charged with obstruction. I made a FOIL request. This request includes the body cameras and dash cameras and the entire police file. I have not received a response or the file. There were several officers and police cars and the arrest was executed and planned hours before it was made. According to the the policies and procedures, the officers should have been wearing cameras. The public and I deserve a copy of those cameras to see how the arrest occurred and whether the policies were followed. Thank you for your attention.
Thankfully the assault case was dismissed. This was not an arrest for me. It was for another party, and I was allegedly too close to the officer making the arrest. The party was already arrested and in the officer’s vehicle when this happened. I have made several FOIL requests. Orleans County Police Department waited six months to respond, they are supposed to respond within five days. Still no cameras, so no video, no audio, missing evidence, and lacking statements and information from the officers. Unfortunately, this will lead to FOIL request 4. I support the police, but the police officers have to follow their own policies and procedures and have to be forthright, candid and accurate with their statements and evidence. This leads to justice on both sides of the law and a healthy balance of power.
