Arrests

Bench Warrant, 11:00 AM, Wednesday, October 27, 2021, N. Spruce St. – Thomas TACITO, M/61 of Batavia NY was arrested on six outstanding bench warrants issued by Batavia City Court. TACITO had failed to appear on the six outstanding cases he had been arrested on since 4/26/2021 ranging in crimes from Criminal Contempt, Harassment, Disorderly Conduct and Criminal Mischief. TACITO was arraigned in Batavia City Court with Judge Rogers presiding and was held on $5,000A, $10,000B, and $20,000 E. TACITO was transported to the Genesee County Jail where he was held.  

Driving While Intoxicated, 7:49 PM, Tuesday, October 26, 2021, Oak St. – Samantha L. HOY, F/30 of Niagara Falls, NY was arrested on October 26, 2021 for DWI following an incident where she allegedly drove off the road at 205 Oak Street and was found to be operating her vehicle while intoxicated. HOY was issued appearance ticket with a return court date of November 2, 2021 at Batavia City Court.  

Criminal Mischief 4th , 2:40 AM, Tuesday, October 26, 2021, Mill St. – On October 26th, 2021, George J. BUDZINACK, M/41 of Batavia, NY was arrested for Criminal Mischief following an investigation into an incident that occurred on Mill St, where the defendant allegedly broke a door to an apartment after a fight. The defendant was released on an appearance ticket, and is due to appear in Batavia City Court on November 2, 2021.  

Petit Larceny, 8:00 AM, Monday, October 25, 2021, Redfield Pky. – On 10/25/2021, Mark NEWTON, M/53 of Hamburg NY, was arrested on an arrest warrant on two charges of petit larceny. The warrant was issued regarding a 2014 incident where NEWTON, allegedly, accepted a sum of money to complete contracting work, then failed to do so and failed to return the money. NEWTON was processed at the Batavia Police Department, and was arraigned in Batavia City Court by Judge Rogers and was released under the supervision of Genesee Justice. NEWTON is due back in Batavia City Court on 11/17/2021 at 1:00PM.  

Aggravated Driving While Intoxicated, 1:21 PM, Monday, October 21, 2021, W. Main St. – Cody L. PAHURA, M/30 of Darien, NY was arrested on 10/25/2021 on an arrest warrant for aggravated DWI. PAHUTA was arraigned by Judge Rogers of the City of Batavia Court on 10/25/2021 at 1:21PM. PAHUTA was released under the supervision of Genesee Justice and is due back in Batavia City Court on 11/23/2021 at 2:00PM.  

Driving While Intoxicated; Failure to submit to a chemical test, 2:30 AM, Sunday, October 24, 2021, E. Main St. – On 10/24/2021, Philip ESCOBAR, M/32 of Kirvin, TX, was arrested after an investigation into a male sleeping in his truck while waiting in the McDonald’s drive-thru line. ESCOBAR refused to allow the Officer to administer standardized field sobriety tests and also refused to submit to a chemical breath test. ESCOBAR was arraigned in Batavia City Court and released with appearance tickets returnable to Batavia City Court at a later date.  

Grand Larceny, 2:12 PM, Thursday, October 14, 2021, Liberty St. – Phoenix GARCIA-SOBCZAK, M/30 of Elba, NY was arrested on the above date and time for Grand Larceny after he allegedly took a vehicle from another, without permission from the owner. GARCIA-SOBCZAK was issued an appearance ticket and is scheduled to appear in Batavia City Court at a later date.    

Bench Warrant, 2:11 PM, Thursday, October 21, 2021, Ellicott St. – On 10/21/2021, Officer POST arrested Antonio GOODSON, M/31 of Batavia NY, on three active bench and arrest warrants out of Batavia City Court for petit larceny. GOODSON was arraigned in front of Judge BURNS who released GOODSON under the supervision of Genesee Justice. GOODSON is scheduled to appear in Batavia City Court on 10/28/2021 at 1:30PM.  

Driving While Ability Impaired by Drugs; Uninspected motor vehicle; Insufficient turn signal < 100 feet, 1:05 AM, Monday, August 23, 2021, Ellicott St. – On 10/23/2021, Jason SHAFFER, M/41 of Perry, NY was arrested for an incident that took place on 8/23/2021. It is alleged that SHAFFER was stopped for traffic violations and after an investigation it was found that SHAFFER was impaired by drugs while operating a motor vehicle. SHAFFER was released with appearance tickets and is scheduled to appear in Batavia City Court on a later date.  

Following Too closely; Driving While Intoxicated (prior conviction previous 10 years); Driving While Intoxicated – BAC > .18% (prior conviction previous 10 years); Refusal to take breath test; Aggravated Unlicensed Operation 1st Degree, 4:15 PM, Tuesday, October 12, 2021, Ellicott St. – Jillian ANTINORE, F/44 of Batavia NY, was arrested on the above listed charges following an investigation into a motor vehicle accident. ANTINORE was issued traffic tickets, returnable to Batavia City Court on 10/27/2021, and released.  

Criminal Contempt 2nd , 2:17 PM, Sunday, October 10, 2021, Ellsworth Ave. – On 10/10/2021, at 10:00PM, Officer POST arrested Heather DAVIS, F/44, of Batavia NY, for criminal contempt in the second degree after she allegedly had contact with an individual who has an order of protection against her. DAVIS was issued an appearance ticket and released with a return court date of 10/19/2021 at 1:00PM to Batavia City Court.  

Criminal Contempt 2nd; Criminal Possession of a controlled substance 7th; Burglary 2nd; Resisting Arrest, 3:08 AM, Monday, October 11, 2021, Walnut St. – Cody A. BUSH, M/35 of Batavia, NY was arrested on the above listed charges following an incident where he was allegedly found inside the residence of a protected party of an order of protection and the protected party being present. BUSH was later arraigned in Batavia City Court and remanded to the Genesee County Jail without bail. BUSH is scheduled to appear in Batavia City Court on 10/26/2021.  

Criminal Mischief 4th, 5:32 PM, Saturday, October 16, 2021, State St. – On 10/16/2021, Officer POST arrested Jeremy OLSEN, M/48 of Bergen NY, for Criminal Mischief in the 4th degree after he allegedly was caught cutting a tree in a city park. OLSEN was released on an appearance ticket and is scheduled to return to Batavia City Court on 10/26/2021 at 1:00PM.  

Driving While Intoxicated; Driving While Intoxicated BAC > .08%, 10:28 PM, Saturday, October 16, 2021, Ellicott St. – On 10/16/2021, Jesse LORD, M/21 of Batavia, NY was arrested on charges of DWI 1st Offense, and DWI with a BAC greater than .08%. The charges stem from an incident where LORD, allegedly, fled from the scene of a bar fight in a vehicle. Officers observed LORD leaving the scene and stopped his vehicle. LORD performed poorly on field sobriety tests and was arrested. LORD was processed at the Batavia Police Department, and fingerprinted at the Genesee County Jail, and released on Uniform Traffic Tickets returnable to Batavia City Court on 11/2/2021 at 1:00PM.  

Driving While Intoxicated; Driving While Intoxicated >.08% BAC; Unlicensed Operation of a Motor Vehicle; No/Inoperable head lights, 2:27 AM, Sunday, October 17, 2021, E. Main St. – On 10/17/2021, Shelby FRYER, F/26 of Batavia, NY was arrested for driving while intoxicated with .08% BAC or more, after an investigation into a traffic stop. FRYER is alleged to have been operating a motor vehicle with inadequate headlights and not having a valid NYS Driver’s License. During the investigation it was found that FRYER was also operating the motor vehicle while intoxicated by alcoholic beverages. FRYER was arrested and released with appearance tickets to appear in Batavia City Court on 11/2/2021 at 1:00PM.
