GENESEE COUNTY SHERIFF’S REPORT/November 11, 2021

Emily D. Smith, 36, of Batavia, is charged with two counts of criminal possession of a controlled substance 3rd degree, a class B felony, two counts of criminal sale of a controlled substance 3rd degree, a class B felony, criminal nuisance 1st degree, a class E felony, and endangering the welfare of a child, a class A misdemeanor, after an investigation by the Genesee County Local Drug Task Force, into the transportation, sale, and possession of cocaine in and around the city of Batavia on November 9, 2021.

Smith was arraigned in Batavia City Court and was released on her own recognizance. She is due back in court on November 30, 2021 at 2:00p.m.

Brian J. Miller, 40, of Bethany, is charged with DWI, aggravated unlicensed operation 3rd degree, moving from a lane unsafely and refusal to take a breath test, after a one vehicle accident on Rt. 63 in the Town of Bethany at about 6:40p.m. on October 29, 2021.

Miller’s 2015 Camaro left the east shoulder of Rt. 63 and overturned. Miller was able to self extricate from the vehicle.

Miller was arrested on scene and transported to the Genesee County Jail, where he refused to submit to a chemical test.

He was issued appearance tickets and released to a third party. Miller will appear in the the town of Bethany Court on November 24, 2021 at 5:00p.m.

Tyler L. Vanskiver, 25, of Bethany, is charged with harassment 2nd, following a domestic complaint in the town of Bethany on November 2, 2021 at 3:53pm.

Vanskiver was issued an appearance ticket for allegedly striking another male subject.

He will appear in the Town of Bethany Court on December 1, 2021 at 5:00p.m.
