GENESEE COUNTY SHERIFF’S REPORT/Pair charged in check cashing fraud scheme

On Monday, November 15, 2021, the Genesee County Sheriff’s Office Road Patrol and Criminal Investigative Division, arrested Brian N. Miles, 25, and Marcus D. Snow, 23, both of Rochester, after an investigation into a check cashing fraud scheme that was known to law enforcement.

The fraud is as follows:

The suspect solicits a person to cash a check for them at a local bank under the pretenses they do not have identification on them or they are not a member. When the person agrees to do so, they cash the check into their bank account remotely at an automated teller machine. The person is then directed to withdraw the deposited funds and the withdrawn cash is then provided to the suspect. The suspect then provides the person a small monetary sum for assisting the suspect in cashing the check for them.

The checks are either fraudulent in their creation or stolen and not backed by any real United States currency. The person is then depleted of the deposited funds from their own bank account once the check is reversed and found to be fraudulent.

Miles allegedly solicited a patron of the ESL Federal Credit Union to cash a check for him, following the same fraud as mentioned above.

Once taken into custody, Miles was allegedly found to have possessed stolen checks from Irondequoit that were used during the commission of the crime. Miles also allegedly possessed a quantity of crack cocaine.

Miles is charged with attempted forgery 2nd degree, a class E felony, criminal possession of stolen property 5th degree, a class A misdemeanor, and criminal possession of a controlled substance 7th degree, a class A misdemeanor.

Marcus D. Snow

Snow is alleged to have conspired with Miles during the commission of the crime.

Snow is charged with conspiracy 5th degree, a class A misdemeanor.

Both Miles and Snow were released following issuance of appearance tickets in accordance with NYS Bail Reform as they are not qualifying offenses.

The Sheriff’s Office would like to make the public aware of this type of fraudulent activity and to avoid unknown persons asking to deposit checks for them.

The public is encouraged to notify the Genesee County Emergency Dispatch Center by calling 911 or 585-343-5000, if they are solicited to cash checks for someone who is unknown to them.

Tonya M. Weber, 37, of Liberty St., Batavia, is charged with petit larceny after allegedly taking items from Five Below at 4212 Veteran’s Memorial Drive on November 17, 2021 at 7:00p.m.

Weber allegedly passed all points of sale and did not render payment.

Weber was transported to the Genesee County Jail for processing and was released with an appearance ticket. Weber will appear in Batavia Town Court on December 2, 2021 at 1:00p.m.
