Marshall, who had been stopped by deputies for not having a front license plate on his vehicle, was observed to be exhibiting general indicators of drug impairment. He performed poorly on roadside standardized field sobriety testing at which time he was placed under arrest for driving while ability impaired by drugs.
Marshall’s vehicle was towed from the scene, and he was taken to the Wyoming County Sheriff’s Office where he was evaluated by a Drug Recognition Expert. Marshall was found to allegedly be impaired by drugs and unable to operate a vehicle safely.
He is charged with DWAI/drugs and no front plate. He was asked to submit to a chemical test, which he refused to submit to. Marshall was therefore arraigned in front of the Warsaw Town Court where his driver’s license was suspended due to his refusal to submit to a chemical test.
