WYOMING COUNTY/Driver identified and charged in pedestrian hit and run in Attica

The Attica Police Department has identified the driver of a red Super Duty pickup truck that was involved in a hit and run pedestrian accident on Market street in the Village of Attica on November 22, 2021.

An investigation by the Attica Police Department, with tips from the public and surveillance video in the area of the accident, assisted in identifying the driver, Brian K. Werner, 34, of Alexander as the operator of the pickup.

Werner is charged with leaving the scene of a personal injury accident in the hit and run accident that occurred about 5:45p.m.

The victim, 95 year old Volney Spencer, suffered facial and arm injuries after being stuck by the pickup. He was found sitting on the curb by officers when they arrived on scene, a witness assisted him to the curb and blocked the intersection so other vehicles would not strike the man. Spencer was transported to WCCH by Attica Ambulance. He was treated and later released.

Werner will appear in the Village of Attica Court on December 13, 2021.

The NYS Police assisted with the investigation.
