GENESEE COUNTY/Man indicted for making a false report at City School

James L. Simonds has been indicted by a Genesee County Grand Jury and is accused of burglary 3rd, a class D felony, after knowingly and unlawfully entering a building, John Kennedy School at 166 Vine Street in Batavia, on January 28, 2021 with intent to commit a crime.

In count 2, Simonds is accused of making a false report/fire/explosion, hazardous substance on school grounds, a class D felony, on the same date and location mentioned in count 1. Simonds, allegedly knowing the information reported, conveyed or circulated to be false or baseless and under circumstances in which public alarm or inconvenience would result. He initiated or circulated a report or warning of an alleged occurrence or an impending occurrence of a fire, an explosion, or the release of hazardous substance upon school grounds.

In count 3, Simonds is accused of the crime of endangering the welfare of a child, a class A misdemeanor, on the same above date, time and location. Simonds knowingly acted in a manner likely to be injurious to the physical, mental or moral welfare of a child less than 17 years old.

Robert C. Strollo has been indicted and is accused of failure to register a change of address as a sex offender, a class E felony, in violation of corrections law section 168-f(4). The incident occurred on December 1, 2021, Strollo allegedly failed to register a change of address with the NYS Division of Criminal Justice Service within 10 calendar days.

A Genesee County Grand Jury has indicted Cynthia M. Mack, accusing her of the crime of burglary 3rd degree, a class D felony. Mack is accused of knowingly and unlawfully entering a building on Lake street in the Town of LeRoy on June 4, 2021.

In count 2, Mack is accused of criminal mischief 4th degree, a class A misdemeanor, on the same above date and location, for intentionally damaging property of another person.
