PERRY POLICE REPORT/April 27, 2022

PERRY, NY- Chief Michael J. Grover reports the arrest of a Rome, NY resident on several charges following an investigation by the Perry Police Department.

On April 22, 2022, Officer Spencer Kramell conducted a traffic stop on South Main Street at Birchwood Acres for a vehicle and traffic law violation. Upon interacting with the suspect, 20-year-old Benjamin J. Miller, of Rome, NY, Officer Kramell suspected Miller to be impaired.

Officer Kramell requested Miller submit to Standardized Field Sobriety Tests, which he complied. Miller did not perform the tests as instructed and was subsequently arrested for Driving While Ability Impaired (DWAI) by drugs(s) along with speeding in a zone (44/30mph zone).

A Drug Recognition Expert (DRE) was requested to perform an evaluation, which Miller consented to. Deputy Nowak of the Wyoming County Sheriff’s Office, a certified DRE, met with Miller at Perry Police Department to conduct the evaluation. It was the Deputy’s expert opinion that Miller was allegedly impaired by cannabis and, therefore, was unable to operate a motor vehicle safely on a public highway. Miller was processed at the Perry Police Department. Per NYS Bail Reform, Miller was released to a sober third party and is to appear in Perry Village Court on June 7, 2022, for the above charges.

Also assisting with the investigation was Officer David Spink of the Perry Police Department.
