BATAVIA/Police quickly nab suspect in Subway robbery on East Main street

On May 17th at 5:56PM, Batavia Police responded to Subway, located at 412 East Main Street, for a reported robbery. It was reported to responding officers that the suspect had fled in an easterly direction. There were no weapons displayed, or threatened, at the time of the incident.

Batavia Officers were in the area, when an officer located a male matching the description at an apartment complex on East Main Street. The suspect was taken into custody and identified as Benito A. Gay, 34, of Batavia.

Evidence was recovered subsequent to the arrest.

Gay is charged with robbery 3rd degree and burglary 3rd degree, both class D felonies.

Gay was arraigned in Batavia City Court by Judge Burns and held without bail. He is scheduled to appear in Batavia City Court on May 19th at 1:30P.M.
